Rehabilitation and reformation of juveniles in conflict with law in Bharat

The latest Juvenile Justice Act states that the process of rehabilitation and social integration of juvenile delinquents or children in conflict with law shall be undertaken in the observation homes, if the child is not released on bail or in special homes or place of safety or fit facility or with a fit person, if placed there by the order of the Board.

The Children’s Court must guarantee that, in the case of a child in conflict with the law, the final order includes an individual care plan for the child’s rehabilitation, which includes follow-up by the probation officer, the District Child Protection Unit, or a social worker. The Children’s Court must also ensure that the probation officer, the District Child Protection Unit, or a social worker, as required, submits a periodic follow-up report every year to evaluate the child’s progress in the place of safety and to ensure that the child is not subjected to any form of ill-treatment.

However despite the strictness and use of strong punishment measures for juveniles offenders committing heinous crimes the Act respects International treaties and conventions signed and ratified by India. Section 21 of the JJ Act, 2015 also mentions that “No child in conflict with the law shall be sentenced to death or life imprisonment without the possibility of release. As a result, while punishment for an offence may be “death” (Section 302, IPC) or “imprisonment for life, which may mean imprisonment for the remainder of that person’s natural life” (Section 376-A, IPC), such a sentence cannot be imposed on a juvenile offender.

Juvenile Immunity: (In IPC; Section 82 and Section 83)

Section 82 and Section 83 of the Indian Penal Code grants immunity to juvenile offenders from criminal responsibility. The idea of granting immunity to juvenile offenders comes from the accepted notion that moral delinquency is an prerequisite of criminal liability and hence young children could not be  made liable for criminal guilt.

Sec 82 states that “Act of a child under seven years of age. – Nothing is an offence which is done by a child under seven years of age”. Section 82 provides absolute immunity which absolves a child under the age of 7 years of criminal responsibility as a child below this age  is considered doli incapax (deemed incapable) by law. Hence if a child below the age of 7 is charged for committing an offence then the mere fact that the accused child was below 7 years  of age is ipso facto (by the very fact) an answer to prosecution. The scope of the absolute immunity granted under this section is wide enough to exempt a child not only from prosecution for offences under IPC but also offences under the special as well as local laws.

Section 83  provides qualified immunity to a child between the age group of 7 to 12 years of age. According to this section if it shows that a child of the above stated age group has not attained maturity to judge the nature and consequences of his act then he is exempted from his /her criminal responsibility. The presumption of innocence of a child is based on the idea that malice makes up for age i.e. malitia supplet aetatem. And hence as age advances the maxim loses its force. The presumption of innocence can also be rebutted by the evidence off “mischievous discretion” i.e. knowledge that what was done was morally wrong.

Under Indian law a child above the age of 12 is fully liable and responsible for his or her deeds under criminal law. However unless the child attains the age of majority i.e. 18 years there are certain safeguards for the juvenile offenders.  These include – prohibition on execution, classification of offences into –petty, serious and heinous offences, separate trials for children.

Delinquency among juvenile girls

Similarly, like crime committed by adults there is a universal agreement among criminologists that girls and women fall foul of law much less frequently than boys or men. And even if they commit delinquent activities they are not very aggressive or destructive to the society and can be regarded as dangerous and can be considered in a much less serious light. This is partly because of the biological factors as girls are less aggressive. There is some evidence that high levels of estradiol and progesterone are associated with low levels of aggression and both these hormones are present in girls at a high level.

Apart from this girls have a very strong familial ties which is much more stronger as compared to boys who during their adolescence mostly have a strong peer ties and as we know that peer pressure and peer misguidance often leads juveniles to delinquency is mostly absent among girls.  Thus apart from genetic or biological factors their social upbringing also makes them less prone to delinquent behaviour.

Women are brought up to be mostly reserved and their socialization in our patriarchal society leads to a form of personality among the females that is characterised by being more prudent, more timid , more lacking in enterprise and most importantly this guards them against delinquency.

The behaviour of boys are more sensitive to environmental influences, and may require  relatively small stresses to become delinquent, compared with large stress needed in case of the girl. However the greater immunity enjoyed by the girls over boys regarding their proneness and susceptibility to delinquent behaviour can impaired by physical and psychological disadvantages and they may be overwhelmed if the environmental forces are of unusual strength and may lead them to unlawful activities.

Female juvenile offenders are mostly found to be engaged in prostitution or helping their family members to carry out their illegal profession or in a few cases are engaged in stealing (because of poverty). According to the “Crime in India” report 99% of the juveniles apprehended for crimes in 2018 were boys.

The factors that lead girls to engage in delinquent activities  are the same as for boys- these include mostly families engaged in criminal or unlawful activities, extreme poverty, broken homes, presence of antisocial elements in the locality or vicinity and coming in contact with them.

Conclusion

In Indian perspective the juvenile delinquency is negligible as compared to the western countries. The data shows from the National Crimes Report Bureau report that the percentage of juvenile crimes to total crimes is 1.2%  in 2013. But it is found from the statistics that it is slightly increasing from 1.00% to 1.20% from 2003 to 2013.

Though it is negligible but alarming hence focus on this matter is required to be given to make our country free from criminality. Only a retributive or deterrent approach cannot curb the problem. Positive measures like reformation, rehabilitation, and re-integration with the society at large is required to be adopted in this regard.

SC notice on plea for raising women’s ‘marriageable age’ under Muslim personal law

The Supreme Court on Friday issued notice to the Centre on a plea by the National Commission for Women seeking a direction to make the marriageable age of girls/women of all communities as 18 years, irrespective of their religion.

The plea, filed through advocate Nitin Saluja, sought a direction on the equal application of the Protection of Children from Sexual Offences (POCSO) Act, the IPC, and the Prohibition of Child Marriage (PCM) Act should be given effect irrespective of religion/personal laws.

A bench, headed by Chief Justice D.Y. Chandrachud, issued notice on the plea.

The plea said sought the enforcement of the fundamental rights of minor Muslim women, guaranteed under Articles 14, 15 and 21 of the Constitution, by seeking that equal application of the penal laws to Muslim women, who have contracted a marriage before attaining the age of majority, whether consensually or otherwise, be given effect to irrespective of their religion/personal laws.

The NCW also sought a direction to increase of ‘marriageable age’ under the Muslim personal law to bring the same in consonance with the penal laws.

“The ‘minimum age of marriage’ under various personal laws, other than the Muslim personal law, is consistent and in consonance with other prevailing penal laws. Under the Indian Christian Marriage Act, 1872, Parsi Marriage and Divorce Act, 1936, Special Marriage Act, 1954 and Hindu Marriage Act, 1955, the ‘minimum age of marriage’ for a man is 21 years and for a woman is 18 years,” said the plea.

The plea added, however, under the Muslim personal law in India, which continues to remain uncodified and unconsolidated, persons who have attained puberty are eligible to get married i.e., on attaining the age of 15 years (in absence of evidence), while they are still minor.

“The same is not only arbitrary, irrational and discriminatory but also violative of the provisions of penal laws. The Protection of Children from Sexual Offences Act, 2012, has been enacted to protect children (below 18 years), particularly women, from offences of sexual assault, sexual harassment, etc.”, it added.

The plea contended that as per Section 375 of the Indian Penal Code, which defines the offence of “rape”, the consent of a women below the age of 18 years is not a valid consent in the eyes of the law and any sexual activity, as defined therein, with a minor, with or without consent, is a punishable offence.

“Solemnisation of a marriage of man below the age of 21 years and of a woman below the age of 18 years is a punishable offence under the Prohibition of Child Marriage Act, 2006. Thus, the Muslim personal law, which permits children to get married on attaining puberty i.e., at the age of 15 years, is in the teeth of the aforesaid penal provisions,” said the plea.

IPS officer shunted out of Chandigarh by Punjab Governor is mired in controversies

As the controversy over the premature repatriation of Kuldip Singh Chahal from the post of SSP, Union Territory of Chandigarh, to his parent cadre Punjab rages, skeletons from the IPS officer’s cupboard are tumbling out.

It was during Kuldip Singh Chahal’s tenure as SSP, Mohali in 2019 a controversial FIR was lodged against gangster Mukhtar Ansari who was brought from a prison in Uttar Pradesh to Ropar Jail in Punjab where he was provided luxurious facilities in violation of norms. Punjab Chief Minister Bhagwant Mann has already ordered an investigation to find out the officers responsible for bringing Ansari to the state and providing him with all luxuries in jail. The case has turned out to be a major embarrassment for the Punjab government.

It also alleged that it was during the tenure of Chahal that a false FIR was registered at Zirakpur police station against Poonam Rajan and members of her family at the behest of AIG Ashish Kapoor. According to sources, who worked under Chahal, the Zirakpur SHO Pawan Kumar was allegedly summoned by Chahal to his office and directed to register an FIR based on a false complaint of Loveesh Jain. This has been proved in the Punjab Police Complaints Authority report dated November 3, 2022.

According to highly placed police sources, Chahal allegedly did this to pay back an obligation to Ashish Kapoor, the then AIG Vigilance Bureau, Mohali. Kapoor had earlier helped Chahal in Vigilance Bureau FIR number 13 of 2020.

This FIR was against naib tehsildar Varinder Dhoot and 10 others regarding a multi-crore land scandal in Majri tehsil, Mohali. Certain IPS officers were found to have bought Benami farmhouses taking advantage of the scandal and could be fixed in the case as accused, but were let go scot-free by Ashish Kapoor.

During his tenure as SSP Muktsar in 2015, Chahal, as per a petition filed by one Balwinder Singh of village Chak Uttar Singh Wala in a Muktsar court, attempted to grab a piece of his prime land on the National Highway with the support of an Akali MLA Rozy Barkandi. A false FIR was registered against Balwinder Singh and he was tortured using third-degree methods. The next date of hearing in the case against Chahal is January 2, 2023.

A complaint by a serving lady sub-inspector of police (the name is being deliberately withheld) in April 2020, was also lodged against Chahal. He was allegedly stalking the officer and inviting her to accompany him for outings through messages on her mobile phone. After she spurned the advances of SSP Chahal, he started transferring her from one police station to another to harass her, the lady officer alleged in her complaint to ADGP Gurpreet Deo. The then SSP Fatehgarh Sahib Amneet K. Kondal inquired into the complaint. But later with the intervention of an Congress Cabinet Minister of Bathinda a compromise was arrived at.

As SSP Chandigarh Chahal in January 2022 also booked and arrested Inspector Satwant Singh Sidhu on the charge that he had forged the signatures of former Punjab DGP Sidharth Chattopadhyay on some transfer orders.

This was done despite Chattopadhyay having informed the then UT SP Ketan Bansal on the phone that the signatures on the transfer orders of two policemen to CIA staff, Kharar, were genuinely his. Chahal had a grudge against Inspector Sidhu as the latter arrested some policemen close to the SSP in a bribery case without his prior permission.

There is yet another hidden story about Chahal not arresting one Parvar Nishan Singh (24) — son of AIG Sarbjit Singh of Punjab police — from who’s Rubicon jeep an unlicensed Glock pistol and 13 cartridges were recovered at a nakka set up by Chandigarh police on September 3, 2022.

AIG Sarbjit Singh, then posted in the Bureau of Investigation (BOI), was tasked to inquire into the leaking of a secret audio clip related to a sensitive anti-terrorist operation of the Punjab police on January 21, 2022, that compromised national security.

The audio clip showed the then Punjab DGP Chattopadhyay conferring about plans for the busting of Pakistan-based terrorist Rinda’s gang operating in Punjab.

The two persons with whom DGP Chattopadhayaya conferred were Inspector Satwant Singh Sidhu and Sarbjit Singh, a dismissed inspector of Punjab police. Later, Sidhu was arrested by Chahal in Chandigarh on January 18, 2022, and his phone was taken into custody. The phone had a recording of the discussion with DGP Chattopadhayaya regarding their proposed operation to bust Rinda’s gang. The audio leak took place on Jan 21 when the mobile phone was in the custody of the Chandigarh police.

Since Chahal was the SSP Chandigarh, Punjab police officials claim that he should be held responsible for the leak which compromised national security. However, in the inquiry held by AIG Sarbjit Singh, departmental action was recommended against Inspector Sidhu on the ground that he leaked the audio and no mention was made of the Chandigarh police officials who had the phone in their custody.

It is being alleged that as a quid pro quo AIG Sarbjit’s son Parvar Nishan Singh was not arrested by Chandigarh police for possessing an unlicensed pistol and cartridges in September this year.

राहुल गाँधी की ‘भारत जोड़ो यात्रा’ से प्रेरित हो एक पादरी ने देश में ‘हिन्दुओं के धर्मांतरण’ की यात्रा निकालने का आह्वान किया

एक स्वयंघोषित पादरी का वीडियो सामने आया है जिसमें हिन्दुओं को ईसाई बनाने के लिए “भारत जोड़ो” जैसी एक यात्रा निकालने का आह्वान किया जा रहा है। इस पादरी द्वारा आयोजित एक नकली उपचार सत्र में, हिंदू महिलाओं को ईसाई रिलिजन स्वीकार करने के लिए प्रेरित किया गया और उन्हें विश्वास दिलाया गया कि “पत्थर की पूजा करना” व्यर्थ है । हालांकि जब स्थानीय लोगों ने इसकी शिकायत की तो इस कार्यक्रम पर रोक लगा दी गयी।

8 दिसंबर को आयोजित होने वाले उपचार प्रार्थना सत्र के पोस्टर घटना के कुछ दिन पहले बारामती में दिखाई दिए थे। इसके अतिरिक्त इस पादरी ने इशू की प्रार्थना और कुछ आभासी गतिविधि कर लोगों की बीमारियां ठीक करने और इनकी सामाजिक और वित्तीय समस्याओं को हल करने का दावा भी किया। इन पोस्टरों में कहा गया है, “यह ईश्वर की इच्छा है कि हम ईसाई रिलिजन में एक साथ आएं।”

इस प्रार्थना सभा का आयोजन बारामती के वसंतनगर निवासी स्वयंभू पादरी सुनील जाधव ने किया था। स्थानीय लोगों को यह एक ईसाईयों के लिए एक प्रार्थना का आयोजन लग रहा था, लेकिन बाद में यह ज्ञात हुआ कि कुछ हिंदू महिलाएं भी इस कार्यक्रम में सम्मिलित हुईं थी और उनका अवैध धर्मांतरण कर ईसाई बना दिया गया था।

ऑपइंडिया ने इस 3-दिवसीय कार्यक्रम को विस्तार से कवर किया था। उनके अनुसार मिशन हाई स्कूल में पहले दिन पश्चिमी भारत में चर्च ऑफ क्राइस्ट द्वारा संचालित इस आयोजन में पादरी जाधव ने कहा कि वे ‘भारत जोड़ो यात्रा’ जैसी यात्रा का आयोजन करने वाले हैं, जिसका एक ही ध्येय होगा, देश भर में हिन्दुओं और सिखों को परिवर्तित कर के ईसाई बनाना।

जाधव ने कहा था, “ईसाई धर्म में विश्वास करो, यीशु के अस्तित्व में विश्वास करो”। जाधव ने आह्वान करते हुए कहा कि “अगर आप अभी बदलते हैं तो ही आप देश भर में कई लोगों को बदल पाएंगे। आपके समर्थन से हम भारत जोड़ो जैसी यात्रा करेंगे और देश भर में लोगों में ईसाई रिलिजन के प्रति विश्वास बढ़ाने का कार्य करेंगे।

हिन्दू महिलाओं को देवी देवताओं के विरुद्ध भ्रमित करते हुए – स्त्रोत: Opindia

पादरी जाधव के बाद लोगों को सम्बोधित करते हुए उपदेशक मैरी ने पंडितों पर विश्वास करने के लिए हिंदुओं को मूर्ख बताते हुए उन्हें अपशब्द कहे । उसने कहा, “यीशु का दरबार रे हमें प्यारा लगता है, तेरे दरबार में कौन कौन आए, पंडित, मुरख, गवार रे हमें प्यारा लगता है”। बड़ी ही आश्चर्य की बात थी कि जब यह पादरी और उसकी सहयोगी मंच पर हिंदू मान्यताओं का अपमान कर रहे थे, उसी समय नीचे उनके सहयोगी और शिष्य नवागंतुकों से बात कर रहे थे। वह लोग विशेष रूप से हिंदू महिलाओं को ईसाई रिलिजन में परिवर्तित करने का प्रयास कर रहे थे।

इस पादरी ने हिंदू देवी-देवताओं को गाली देते हुए कहा, “ईश्वर अदृश्य है, हमें उसे महसूस करना चाहिए। हमें पत्थरों की बनी मूर्तियों की पूजा नहीं करनी चाहिए, जैसे हिन्दू किया करते हैं। वह पत्थर क्या हमारी बात समझ सकता है? हम, मनुष्य, पापों से घिरे हुए हैं, अपनी आने वाली पीढ़ियों को पापों से मुक्त करने के लिए, आप भोले-भाले हिन्दुओं को हिंदू धर्म को छोड़ कर अधिक आकर्षक ईसाई रिलिजन को अपना लेना चाहिए।

इस आयोजन में कथित ‘हीलिंग प्रार्थना’ के पश्चात कार्यक्रम के मुख्य अतिथि पादरी अनीश विजगत ने मंच संभाला। इस पादरी ने दावा किया कि वह एक बिशप है और उसके अधीन 300 से ज्यादा पादरी काम कर रहे हैं। वह पुणे में ग्लोरियस इंजीलिकल प्रॉफेटिक मिनिस्ट्रीज चलाते हैं और अपनी पत्नी के सहयोग से ईसाई रिलिजन का प्रचार करते हैं।

पादरी अनीश विजगत स्वयं को एक महत्वपूर्ण व्यक्ति के रूप में दिखाने के लिए अंतर्राष्ट्रीय मानवाधिकार परिषद (आईएचआरसी) और भ्रष्टाचार विरोधी संस्था से जुड़े होने का दावा करता है। हालांकि आईएचआरसी की वेबसाइट पर इस पादरी के बारे में कोई भी विवरण नहीं मिलता है। लेकिन एनजीओ दर्पण के पोर्टल पर उपलब्ध जानकारी से पता लगता है कि सनी शाह इसका अध्यक्ष है और नशीत अफरोज इसका महासचिव है।

कार्यक्रम के समय एक बैग में दान इकठ्ठा किया जा रहा था

अनीश विजगत ‘एंटी करप्शन एंड मीडिया इन्वेस्टिगेशन’ नाम की एक गैर सरकारी संस्था चलाने का दावा भी करता है। वहीं स्थानीय लोगों के अनुसार अनीश अपने घर पर ही एक चर्च का संचालन करता है, जहां खुलेआम धर्मांतरण किया जाता है। बैठक के आखिरी दो दिन ‘ज्येष्ठ नागरिक संघ’ में होने थे, जो एक तरह का कम्युनिटी हॉल है। जब ऑपइंडिया ने इस घटना के बारे में पूछताछ करने के लिए संघ से संपर्क किया, तो उन्होंने धर्मांतरण के प्रयासों के बारे में अनभिज्ञता जताते हुए कहा कि उन्होंने केवल प्रार्थना सभा आयोजित करने की अनुमति ली थी।

हालांकि, इसके पश्चात स्थानीय लोगों के कड़े विरोध के बाद इस कार्यक्रम को रद्द कर दिया गया था। पहले दो दिनों में, सत्र के अंत में, सभी को पैसे डालने के लिए एक थैला दिया गया। गरीब लोग जो अपनी समस्याओं के समाधान ढूढंने वहां गए थे, उनसे उलटा भुगतान करवाया गया। यूट्यूब पर एक वीडियो पादरी विजगत के ‘इवेंजेलिकल प्रॉफेटिक मिनिस्ट्री’ के ध्येय पर प्रकाश डालता है। उसका एकमात्र ध्येय गैर ईसाईयों को अपना शिष्य बनाना और और अंततः उनका धर्मांतरण करना है। विजगत की पत्नी जूलिया महिलाओं को भ्रमित करती है और पादरी की महिला सहयोगियों को प्रशिक्षण भी देती है।

पादरी और उनके सहयोगी अध्यात्म के नाम पर गैर ईसाईयों को भ्रमित करते हैं और उनका धर्म परिवर्तित करते हैं, जो धर्म के लिए बड़ा ही खतरनाक होता है। ऐसे लोग लोगों को यह विश्वास दिलाते हैं कि उनकी बीमारियों और आर्थिक कठिनाइयों को दूर करने के लिए उन्हें प्रभु इशू की प्रार्थनाओं की ही आवश्यकता पड़ेगी। उन्हें हिन्दू देवी देवताओं का त्याग कर देना चाहिए। यह लोग बीमार लोगों को ठीक करने और यहाँ तक की मृत लोगों को पुनर्जीवित करने का दावा भी करते हैं।

Bharat-Russia ties go deeper with provinces getting into the act

The geography of partnership between Moscow and Bharat is not just limited to New Delhi, Russian Ambassador to Bharat Denis Alipov has said.

Speaking at a business forum in New Delhi on Wednesday, which was attended by a delegation of local administration from the Russian capital, Alipov said that Moscow has become one of the leaders in the development of interregional partnership between Russia and Bharat in various fields.

“Reflecting the need of the times, Moscow is taking the initiative to further develop bilateral dialogue to deepen cooperation in digitalization, ICT, engineering, pharmaceuticals, construction, logistics and other areas, with a focus on high technology and innovative solutions,” the ambassador was quoted as saying by the Russian embassy.

He also noted at the event that Moscow is developing ties not only with the Indian capital, but also with other regions of Bharat.

“It is important that the geography of partnership between Moscow and India is not limited to New Delhi, although this is an important component. The metropolis of Mumbai, the state of Kerala and other partners are also in the area of attention, as well as various business projects and programmes for developing people-to-people ties,” added Alipov.

On the sidelines of the same event, Russian Trade Commissioner in Bharat Alexander Rybas held an interaction with mediapersons from his country, stressing the importance of developing interregional relations which are an additional source of increasing trade turnover and cooperation in the investment field.

Hoping that new contracts in different areas are in the offing, Rybas mentioned that besides oil, Russia can supply other goods and is keen on developing further opportunities.

“Of course, we have to work in various areas. You know what India’s plans are for building airfields, for building up energy capacities. India is going full steam into the future, and we must find our place in order to help India become strong and prosperous country. And, India should help us move along the path to prosperity as well,” said the Russian trade representative.

Not just Moscow, but several Russian regions continue to express their interest in expanding partnership and the scope of interaction with Bharat.

Last week, a delegation of the Novgorod Region, completed a working visit to Bharat under the leadership of Governor Andrei Nikitin.

It included representatives of the regional government and the mayor’s office of Veliky Novgorod – the oldest city in Russia which is also regarded as the cradle of Russian democracy – besides business and Novgorod State University (NovSU) officials.

The Novgorodians held a series of meetings with Bharatiya colleagues in the areas of business and the development of the nuclear industry, science and education, and also visited the Kudankulam nuclear power plant under construction, with which the Novgorod corporation Splav cooperates on the supply of fittings.

Representatives of seven Novgorod enterprises also held “very productive” meetings with potential Bharatiya partners, and NovSU formalised an intention to cooperate with the University of Kerala.

The Mayor of Veliky Novgorod, A Rozbaum and the Trivandrum Mayor Arya Rajendran agreed at a personal meeting to establish sister city ties and cultural exchanges.

“Each of the Novgorod entrepreneurs who worked with a business mission found an Indian partner for cooperation, and more than one. Hindus under attack: a weekly roundup of hate crimes, persecution, and discrimination against Hindus

Attacks on Hindus and Hindu Dharma, both in Bharat and overseas, are frequent and unrelenting. In many regions of the world, this persecution is like a genocide slowly unfolding before our eyes. For decades, the world has ignored the actual depth and breadth of these attacks, driven by disturbing anti-Hindu bigotry. From murders, forced conversions, land grabs, assault on festivals, desecration of temples and murtis, hate speech, and sexual violence to institutionalized & legal discrimination, Hindus are facing an increasing assault on their very existence along with an unprecedented Hindu hatred.

In this weekly summary for the period from 04 December to 17 December 2022, we hope to provide a snapshot of such crimes and hopefully awaken more people around the world to this human rights crisis:

Bharat

1) A case of police brutality has come to light from Congress-ruled Chhattisgarh. The incident took place in Jashpur where Hindus were protesting peacefully against love jihad.

2) In yet another incident which reflects the deadly religiously-indoctrinated mindset rampant within Bharat’s ‘minority’ population, one Sheikh Shakeel Miyan murdered a 42-year-old married woman named Neelam Yadav in broad daylight in the most grotesque manner. Miyan was aided in this crime by his brother Mohammed Zuddin – both are reported to have been arrested.

3) In yet another grooming jihad case, a 16-year-old SC Hindu girl was abducted by one Aman Sheikh who posed as Amrut Ram Khairnar using forged documents like Aadhaar. The girl was kidnapped by the man when she was visiting the Sai Baba temple in Shirdi. 

4) ASI bows down to land jihad as Muslims will continue using historical Buddhist cave as Mazar.

5) A temple priest from an SC (Scheduled Caste) community in Andhra Pradesh has posted a video narrating his alleged harassment at the hand of Christian villagers, who constitute an overwhelming majority in his village, to convert to Christianity and abandon the temple. The priest claims that the accused have also foisted false cases on him.

6) Young Greeshma who converted to Islam for marriage has reportedly died by ‘suicide’ in Thrissur, Kerala. The victim’s family called it a suspicious death and alleged that her husband murdered her.

7) TN HRCE Board, trusted with the protection of temples, has vandalised a temple sculpture to install a CCTV camera. After much outrage and BJP taking up the issue, the CCTV camera was removed, and the sculpture of Dwarapalaka was hastily restored.

8) A married woman was raped inside her house in Uttar Pradesh’s Moradabad district on Saturday by fridge repairman Asif, police said. The accused was arrested on Monday.

9) Deepu Jadam (22) was murdered by a suspected Islamist gang consisting of Sohail and others when he stopped them from sexually harassing his cousin sister during the ongoing Kartik fair in the temple town of Ujjain.

10) Maharashtra police have booked a Christian man for physically abusing his wife for more than 20 years for not converting to Christianity. He harassed her parents as well and wanted the children to be converted. He threw away the images and murtis of Hindu deities worshipped by his wife.

11) Goons of a Dravidian outfit tried to stop a temple consecration ceremony and threatened to demolish the yagasala. The temple is located inside the premises of Erode Corporation Office and they were against performing yajna in a government office.

12) A man identified as Aslam Khan posed as a Hindu and tricked a poor family to marry their minor daughter to him in Jharkhand’s Bokaro. His real identity surfaced after the Jaimala (garlanding ceremony).

14) A maulvi and 9 others have been arrested for trying to illegally convert a Hindu girl (18) to Islam and carry out her nikah with one Ahmed Ansari. This latest incident of grooming jihad has been reported from the Fatehpur district of UP.

15) An AC mechanic raped a 5-year-old girl inside a high-rise residential building lift while visiting to service an AC in Navi Mumbai, Maharashtra.

16) Hinduphobia raises its ugly head as NE student bodies observe ‘black day’ to mark CAA passage.

17) Repeat offender Hindu-hater MP Thirumavalavan has mocked Hindu beliefs again saying that building temples is a business that would fetch more revenue than any other business.

18) A pastor couple has been arrested for forcibly converting SC people in Karnataka. Their son has been booked under POCSO Act for raping a minor girl on the pretext of marrying her. The pastor threw Hindu deities’ images into a canal and told the converted families that they would go to hell if they continued to pray to Hindu deities. The family has reverted to Hindu dharma now.

19) Muslim coaching centre owner posed as Sameer Khanna and wore a kalawa to fraudulently marry an ex-student.

20) A man, Saif Ali Saleem (26), has been arrested for raping a 14-year-old Hindu janjatiya girl on November 14 outside her school in Morgiri village, Patan taluka of Satara district, Maharashtra.

21) Two local men, identified as Kamal Kumar and Surinder Kumar, both belonging to ward 15 in Rajouri town, were killed and another man, Arun Kumar from Uttarakhand, was injured in firing outside an Army camp, 5 km ahead of Rajouri town which falls in district Rajouri, Jammu division of J&K.

22) A self-proclaimed pastor was heard talking about taking out a “Bharat Jodo” like yatra to convert people to Christianity. In a fake healing session organised by the pastor, Hindu women were proselytised to accept Christianity and convinced that “worshipping stones” is useless. The event was stopped on the third day after complaints.

Bangladesh

Attacks on Hindus in Bangladesh are relentless and designed to cleanse the religious minority from the country gradually. According to a study by Prof. Abul Barakat of Dhaka University, no Hindus will be left in Bangladesh by 2050 due to systemic and institutionalized persecution. Temple desecration, land grabbing, mob attacks after false blasphemy charges, rape/forced conversion of women, and hate speech are tools used to intimidate and drive Hindus out.

1) Three men – Asad Miah, Milon Miah & Kulu Miah – gang-raped a Hindu housewife, a mother of 2 children, after calling her on the pretext of sewing a quilt. The shocking incident took place in Aditmari upazila of Lalmonirhat district in northern Bangladesh, Bengali language national daily Daily Janakantha reported on November 20.

2) Two Hindu sisters, 11th grader Boishakhi Swarnokar & 9th grader Shrabonti Swarnokar were brutally assaulted by Shihab Howlader, Russel Howlader and 3-4 other Muslim youths while the sisters were playing badminton in the field of a local church. The incident took place in Mongla upazila (sub-district), Bagerhat district of southwestern Bangladesh.

3) Bangladeshi writer and actress Dipanwita Roy’s parent’s property has been encroached and they have been threatened with eviction from Bangladesh by two land grabbers – Harun Mollah & Humayun Mollah.

4) Veteran poet Saroj Deb (74) was attacked & beaten by Sazzad Hossain (35) and his gang at the poet’s home in Gaibandha district headquarters town of northern Bangladesh, Bengali-language news outlet NTV has reported.

5) A 200-year-old Hindu temple has been vandalized in the Manikganj district of central Bangladesh. Officer-in-charge Abdur Rouf of the local police station confirmed the news to Bangladeshi news outlet banglanews24 as per a report dated November 20.

6) A Hindu family was attacked and looted in the Khulna district of southwestern Bangladesh. Their home, kitchen, cowshed, paddy shed, and furniture were wrecked, while cash and gold ornaments were looted by a 150-strong Islamist mob.

World

1) In what can be called a classic case of gaslighting through blatant distortion of facts, The Guardian in its recent editorial blamed Hindus living in the UK for the recent Leicester violence and also peddled fake news that mosques were attacked by Hindus of the city.

2) During the ruling Fiji First Party’s meeting in Tavua last weekend, Attorney-General and de-facto Prime Minister of Fiji, Aiyaz Sayed-Khaiyum made extremely condescending and derogatory remarks against the Hindu devotional singers (Bhajaniyas).

3) UK Parliament rebuffs Hindu prayer requests and sittings in both houses always begin with Christian prayers.

4) The UN Economic and Social Council(UN ECOSOC) has granted consultative status to a notorious anti-Hindu organisation, International Dalit Solidarity Network (IDSN). The UK, USA and some European countries reportedly flexed their muscles to make ECOSOC grant the status after 15 years of rejecting IDSN’s application for the same

Most hate crimes are driven by anti-Hindu bigotry encoded in certain religious teachings and political ideologies. While the anti-Hindu hate in Islamic countries is evident, there is another subtler form of anti-Hindu sentiment within institutions and the public sphere of ostensibly secular states (like India) that provides an enabling environment for Hinduphobia and hate crimes. This subtle, everyday discrimination can be missed unless one studies prevailing laws and patterns. The gradual ban on firecrackers during Diwali is a good example – it might seem pollution-related on the surface. Still, the double standards at play become apparent when one looks at the larger picture of restrictions on Hindu festivals and the lack of sound reasoning behind the ban.

मोतिहारी: दानिश आलम ने जलाया तीन बच्चों की माँ हिन्दू प्रेमिका को: प्यार करने की आजादी का नारा लगाने वाले इन हिंसक घटनाओं पर मौन क्यों हैं?

मोतिहारी, बिहार से एक बहुत ही दिल दहला देने वाली घटना सामने आई है। यह घटना हालांकि दानिश आलम द्वारा एक हिन्दू महिला को जलाए जाने की है, परन्तु यह घटना पारिवारिक मूल्यों के छीजने की भी घटना है। यह घटना उन तमाम विमर्शों पर तक तमाचा है जो हर “स्त्री” को “औरत” में बदलने के लिए यह कहते हुए प्रयासरत है कि विवाह होने का अर्थ एक ही व्यक्ति तक सीमित होना नहीं है।

यह कहानी है उस विमर्श की जो हर “औरत” को ईमान में लाने के लिए मचल रहा है, और उसे फेमिनिस्ट “प्यार की आजादी”, “देह की आजादी” कहते हुए हवा दे रही हैं।

बिहार के मोतिहारी में दानिश आलम ने 35 वर्षीय अर्चना कुशवाहा को पेट्रोल डालकर जला दिया। आरोप है कि 35 वर्षीय अर्चना कुशवाहा पर दानिश निकाह का दबाव डाल रहा था। परन्तु जितना घिनौना यह धोखा है कि प्रेमी दानिश ने अर्चना कुशवाहा को जलाया, उससे भी बड़ा धोखा यह है अर्चना कुशवाहा न केवल शादीशुदा है, बल्कि तीन बच्चों की माँ भी है। और ऐसा भी नहीं है कि उसका पति उसे छोड़ गया हो या फिर वह विधवा हो, दरअसल अर्चना कुशवाहा का पति चेन्नई में मजदूरी करता है।

अर्चना का पति बाहर मजदूरी का काम करता है और वह कम ही आता है। ऐसे में पति की अनुपस्थिति में अर्चना को प्यार हो गया एवं प्यार भी दानिश से हुआ, जो उसे जलाने के लिए आ गया। इस घटना में क़ानून दानिश को सजा देगा ही देगा, परन्तु यह भी प्रश्न महत्वपूर्ण है कि आखिर शादीशुदा महिलाऐं, इस प्रकार की घटनाओं में कैसे फंस जाती हैं?

यह कहानी भी एक मिस्ड कॉल से आरम्भ हुई। मीडिया के अनुसार यह घटना भी एक मिस्ड कॉल से आरम्भ हुई और धीरे धीरे अर्चना पिघल गयी। यह घटना सामाजिक स्तर पर भी दिल को परेशान करने वाली है कि आखिर देह की इच्छा या कथित आशिकी इस हद तक हावी हो सकती है कि अपने बच्चों की ओर से भी आँखें मुंदवा दे? यह बात सही है कि यदि पति बाहर है तो देह और मन की अपनी इच्छा हो सकती है, वह बहकने लगता है। परन्तु उसके बहकने के क्या परिणाम हो सकते हैं, इस पर चर्चा क्यों नहीं होती है?

प्रश्न यह भी है जो लोग यह सारा विमर्श तैयार कर चुके हैं कि शादी होने का अर्थ यह नहीं होता कि एक महिला गिरवी हो गयी, या फिर महिला के शरीर की प्यास, मन का अकेलापन कोई तो दूर करेगा ही, वह लोग ऐसी जघन्य घटनाओं पर बात क्यों नहीं करते हैं? क्यों प्यार की आजादी के पैरोकार इस बात को लेकर सामने नहीं आते हैं कि शादी के बाद बाहर सम्बन्ध बनाना मानसिक एवं शारीरिक तथा सामाजिक रूप से भी हानिकारक सिद्ध हो सकता है।

हालांकि मीडिया के अनुसार अर्चना कुशवाहा का कहना है कि

एक लड़का रांग नंबर से कॉल कर रहा था। बोला कि बात करो। हम मना किए कि बात नहीं करेंगे। इस पर कहा कि तुम बात नहीं करेगी तो पूरा खानदान खत्म कर देंगे। फिर ब्लैकमेल करने लगा। हम उसको 5 हजार रुपया दिए। फिर वो 10 हजार रुपया मांगने लगा। हम बोले कि नहीं देंगे। तो कहा कि रुपया नहीं दोगी तो पहले तुमको मार देंगे। फिर तुम्हारे ससुर और हसबैंड को भी मार देंगे। हम नहीं माने तो फिर पता नहीं कैसे घर पहुंच गया।

मगर जो ऑडियो वायरल हो रहा है, वह और ही कहानी कह रहा है। भास्कर में उस ऑडियो का ट्रांसक्रिप्शन भी दिया है। उसके अनुसार

दानिश बोलता है कि मेरा फोन क्यों नहीं उठा रही हो।

महिला- हमें सोना है फोन रखिए। फिर भी दानिश उससे बात करता है।

दानिश-गाली देते हुए कहता है तुम्हें मेरी चिंता नहीं है?

महिला- वो तो भगवान जानते हैं।

दानिश- गली देता है और कहता है कि तुम्हारी बहन हमें चप्पल से मरेगी, उसे भी जान से मार देंगे। तुम्हें, पति और तुम्हारे ससुर को मार देंगे। नहीं तो तुम हमें मरवा दो।

महिला-मैं तो चींटी मार नहीं सकती तो आपको कहां से मरवाऊंगी।

दानिश- हम ठान लिए हैं कि तुम्हें और तुम्हारे पूरे परिवार को मार देंगे। नहीं तो एक बाप का बेटा नहीं। तुम्हें समझाने के लिए फोन कर रहा था। अब तुम्हें मेरी जरूरत नहीं हैं। इसके बाद फोन कट जाता है।

वहीं पुलिस का भी कहना है कि दोनों के बीच डेढ़ साल से प्रेम प्रसंग था और इसी बीच दोनों में झगड़ा हुआ। घोड़ासहन थाना क्षेत्र के विजयी गाँव का दानिश आलम अपने घर से लगभग 70 किलोमीटर की दूरी का सफ़र तय करके अर्चना कुशवाहा के घर पहुंचा। वहां पर उसने देखा कि वह खाना पका रही है तो उसने उसके शरीर पर पेट्रोल डालकर आग लगा दी।

जब महिला ने शरीर में आग लगते ही चिल्लाना आरम्भ किया तो आसपास के लोग इकट्ठा हुए और उन्होंने आग बुझाई और दानिश को पुलिस के हवाले कर दिया! दानिश पुलिस की गिरफ्त में है!

हालांकि ऐसे मामलों में कई बार देखा गया है कि आरोपी परिवार को नुकसान पहुंचाने को लेकर पीड़िता को ब्लैकमेल भी करता है!

दानिश को सजा का निर्धारण क़ानून करेगा, परन्तु प्यार की बेलगाम आजादी से होने वाले ऐसे दुष्परिणामों का निर्धारण कौन करेगा? हिन्दू समाज की स्त्रियों की कथित यौन असंतुष्टि को बाहर संतुष्ट करने वाले विमर्शों से उत्पन्न अपराधों पर कौन बात करेगा?  

NIA files supplementary chargesheet in CPI (Maoist) terrorism case from Assam

The National Investigation Agency (NIA) on Friday filed a supplementary chargesheet against a accused in a case related to CPI (Maoist) activities in Cachar district of Assam at a special court in Guwahati.

The supplementary chargesheet was filed against Samrat Chakraborty a.k.a. Nirman under section 120B of IPC and sections 18, 20, 38 of UA (P) Act.

The case pertains to arrest of two senior CPI(Maoist) leaders namely Arun Kumar Bhattacharjee a.k.a. Kanchan Da and Kajal Urang a.k.a. Akash Urang from Cachar district of Assam.

The case was initially registered at Crime Branch PS, City Guwahati, Kamrup (Metro), Assam and re-registered by the NIA on March 16, 2022. Earlier, the NIA had chargesheeted six accused on September 2.

“Investigations have established that the accused Nirman was an active member of CPI (Maoist), a proscribed terrorist organization. He was part of the conspiracy hatched by the CPI(Maoist) leadership to expand its organizational set-up and operational base in Assam. He stayed at various hideouts in Cachar district of Assam with the intention to expand and strengthen the CPI(Maoist) organization and worked as a link between the leadership of CPI(Maoist) organization in different regions,” read the chargesheet.

Alarm bells ringing in Punjab with rise in attacks on police stations and police protectees

The recent attack on a police station in the border district of Taran Tarn was the fifth of its type in the last 12 months. As in all the earlier attacks, the targets were high profile and important police establishments like the Mohali Intelligence Headquarters, Crime Investigating Agency and Pathankot Cantt Police Post. Another serious dimension, was the insidious and targeted killing of three police protectees.

Just about a month ago, Bhupinder Singh was shot dead at Jalandhar, and the armed constable deployed for his protection, sustained gunshot injuries and he also succumbed to the injuries in hospital. Pradeep Singh was killed in Faridkot. Shiv Sena activist, Sudhir Suri was gunned down in Amritsar.

In the case of Bhupinder Singh, the family informed the police that the gangsters were demanding a ransom of Rs 30 lakh from them.

This is an extremely grim situation and it is absolutely crystal clear that the nexus between Pakistan’s ISI, the local gangsters of Punjab and the pro-Khalistani elements operating from the US, Canada, the UK, Hong Kong, Germany, among others, are working in close coordination to create disturbances in Punjab, using the 1984 anti-Sikh riots, the Covid pandemic, the farmers agitation and the poor job opportunities in the state.

This is borne out by the fact that narco terrorism is an evil that has spread its dreaded tentacles all across the state, drone incursions carry payloads of narcotics, weapons, fake Indian currency, foreign currency, have become brazen and frequent. Drug addiction in Punjab, especially in the youth, has assumed alarming proportions.

In a confidence building measure, DGP Punjab Gaurav Yadav stated that 404 gangsters have been apprehended in recent months. On the face of it, this may be of some consolation as a sign of proactive action- but in the light of the fact that almost 4000 persons of Punjab have been identified as being involved in radical activities, it is also alleged that of these more than 200 received money from the banned pro Khalistani outfit Sikhs for Justice (SFJ).

Although it is a matter of satisfaction that almost 1000 were short listed by the Punjab Police for their deradicalisation programme, with some success. But again the pro-Khalistani elements, mostly from outside India and at the behest of the ISI are hell bent on creating disturbances in Punjab.

There seems to be an eerie similarity between the present condition and the early days of Punjab terrorism of the 80’s. Full credit to the mature leadership provided by the then Directors General of Police, Mr Julius Francis Ribeiro and the late Mr KPS Gill, that terrorism was wiped out. I was fortunate to receive able and timely guidance from Mr Ribeiro and Mr Gill during my tenure in Nainital and Moradabad; we were fortunate to receive contingents of the Punjab Police for close and coordinated action, which worked wonders in stamping out terrorism after years of persistent action against terrorists and their support systems.

If in those times it was Jagjit Singh Chauhan trying to print the ridiculous Khalistan currency, today it’s the Sikhs for Justice and the likes of Pannu, and other anti-national outfits who started merely by creating a Facebook page, website and under the ISI’s patronage and guidance, they have started aggressive vitriolic campaign on the social media platforms like the Twitter, YouTube, Facebook, Instagram etc and also using highly sophisticated and encrypted customised apps for in-house communication.

The time to act was yesterday not today. We are already late in addressing the problems in totality, this problem, obviously, is not to be nipped in the bud but crushed in the bud.

A TV commentator of the ruling party mentioned that we have stepped on the tail of the cobra and naturally it will raise its hood! The obvious combatant’s solution, the world over has been to chop off the head of the cobra, especially those bred and fed by the ISI and Pakistan.

In this grim situation all the intelligence agencies like the IB, Raw, Military Intelligence, BSF the Punjab Police and the Police forces from the neighbouring states, like Kashmir, Haryana, Uttar Pradesh and other sensitive states must share intelligence and ensure pre-emptive strikes on the terrorist hideouts and their support systems. The nexus between the gangsters and the anti-national elements has to be broken once and for all. Till now the decisive assault like action under the National Security Act, UAPA, confiscation of movable and immovable property does not seem to be happening on a war footing.

On the contrary the Supreme Court expressed dissatisfaction over the lax investigation and prosecution of Excise Act cases in Punjab.

It must be borne in mind that these are horrible fault lines that must be addressed – the accused of the Excise Act, in all probability would be directly or indirectly related to those involved in narcotics and other anti-national activities. The requirement of the day is a ruthless drive against all such elements with a no-nonsense attitude.

‘No case is too small for Supreme Court or too big..’: SC vs Centre war of words

The friction points between the Central government and the Supreme Court is rolling beyond the row over delay in appointment of judges.

Law Minister Kiren Rijiju has minced no words in criticising the judiciary on several issues at various platforms, and the judiciary has also shot back at Central government — be it long delay in appointment of judges or underscoring that no case is too big or too small for the Supreme Court as it has to answer the cry of liberty of the citizens.

Recently, Rijiju said in the Parliament that the Supreme Court should not be hearing bail pleas and frivolous PILs amid soaring pendency of cases.

In what appears an indirect response to the minister’s criticism, Chief Justice of India D.Y. Chandrachud on Friday said it is the duty of the apex court to interfere in matters of violation of personal liberty, and judges burn midnight oil for it.

Speaking in Rajya Sabha, the Law Minister appealed to the apex court to take up those cases which are relevant and appropriate, and further added that if the Supreme Court starts hearing bail applications and all frivolous PILs, it will add extra burden on it as a constitutional court.

While releasing a man sentenced to 18 years in jail for electricity theft in 9 separate cases, a bench, headed by Chief Justice Chandrachud and comprising Justice P.S. Narasimha said: “No case is too small for the Supreme Court and no case is too big because we have to answer the call of conscience and the cry of liberty of our citizens, that is why we are here… and these are not one of cases, when you sit here and burn the midnight oil, you realise that everyday there is another one like this…”

The top court it is the duty of the apex court to interfere in matters of violation of personal liberty. Releasing the petitioner, the court, in its order, noted: “The right to personal liberty is an inalienable right. In attending to such grievances, the Supreme Court performs its duty, no more and no less…”.

The Union Law Minister, in the Rajya Sabha, had also said that there was a feeling among the people that long court vacations were not very convenient for justice seekers. In a response, the Chief Justice, in a courtroom full of lawyers, on Friday said that “there will be no benches available from tomorrow till January 1”.

Friday is the last working day for the Supreme Court and it will reopen after two weeks’ winter break on January 2, 2023.
