Need a CEC who can even take action against PM, says SC

The Supreme Court on Wednesday orally observed that the need is for a Chief Election Commissioner (CEC) who can even take action against the Prime Minister and also asked the Centre to show the mechanism adopted in the appointment of an Election Commissioner (EC) last week.

A five-judge Constitution bench headed by Justice K.M. Joseph said: “We need a CEC who can even take action against a PM.”

The bench, also comprising Justices Ajay Rastogi, Aniruddha Bose, Hrishikesh Roy and C.T. Ravikumar, said suppose for example, there is some allegation against the Prime Minister and the CEC has to act, but the the latter is weak-kneed and does not act.

The bench queried the Centre’s counsel that was it not a complete breakdown of the system. The CEC is supposed to be insulated from political influence and should be independent.

It further added that these are aspects on which “you (the Centre’s counsel) must delve into, and why we require an independent larger body for selection and not just Cabinet”. The bench orally observed that committees say dire need for changes, and politicians also shout from rooftop but nothing happens.

The Centre is represented by Attorney General R. Venkataramani, Solicitor General Tushar Mehta, and Additional Solicitor General Balbir Singh. The bench also queried the Centre’s counsel to show the mechanism adopted in the appointment of the Election Commissioner.

Former Bureaucrat Arun Goel assumed the office of Election Commissioner on Monday, after being appointed to the post on November 19. Since May,this year, the post of one Election Commissioner in the three-member Commission was lying vacant after Sushil Chandra retired as the CEC.

During the hearing, the AG contended that the convention is that all senior bureaucrats and officers at the state and the central government are taken into consideration while appointment and this is scrupulously followed. The AG further submitted that the appointment is done on the basis of convention and there is no separate appointment procedure of CEC.

He added that one is appointed as EC and then on the basis of seniority a CEC.

Justice Rastogi observed that there should be a transparent mechanism in the appointment of the EC, and the mechanism should be such that people should not question it.

He added that, “you just appointed someone as EC 2 days ago… It should be fresh in memory. Show us (the mechanism applied in the appointment)”.

At this juncture, the AG replied: “So are we saying that there is no confidence in the Council of Ministers?” to which Justice Rastogi said, “no, we are saying for our satisfaction show us the mechanism you adopted in the appointment two days ago”.

The AG replied that he has already shown how a convention is followed, the process involved in the appointment, and appointments are made on the basis of seniority, and on the aspect of recent EC appointment, he added that the office was vacant since May.

“It is not a pick and choose system at all, there is a process,” said the AG.

The bench said it understands that CEC is appointed from amongst the ECs, but then there is no basis, and why is the Centre only confined to civil servants?

The AG said that is a completely different debate, and can we bring in a national pool of candidates, that is a larger debate.

He further added that there is also an in-built guarantee in the system, whenever the President is not satisfied with the suggestion then he can take an action. The hearing in the matter will continue after lunch.

The top court is hearing a batch of pleas seeking a collegium-like system for the appointment of the CEC.

On Tuesday, the Supreme Court said the CEC heads an institution, though with his truncated tenure, he cannot do anything substantial and added that “silences of the Constitution” is being exploited by all and expressed concern at the absence of a law governing the appointments of ECs and CEC.

Last week, the Centre opposed petitions seeking a collegium-like system for the selection of CECs and ECs. The apex court in October 2018, referred a PIL seeking a collegium-like system for the selection of CECs and ECs to a five-judge Constitution bench.

Editor’s Note

In 1993, Bharat’s judiciary made a naked power grab by overturning the Constitutional provision for appointment of judges and instituting a Collegium System, whereby judges appoint judges. The system is opaque and unaccountable, and has been criticized even by senior Supreme Court judges. We are today the only ‘democracy’ in the world where the elected representatives have little say in the selection and appointment of judges.

While rejecting the NJAC (National Judicial Appointments Commission) bill passed in both houses of Parliament in 2015, SC made the egregious remark that “wisdom of appointment of judges cannot be shared with the political-executive as in India, the organic development of civil society, has not as yet sufficiently evolved”.

Not ‘sufficiently evolved’? In other words, the masses who elect representatives are ‘barbarians’ and the judicial class is ‘civilized’?

How different is this from the rationalization of colonialism by Britain and other European powers, who insisted that ‘child-like natives’ needed to be ruled by a ‘superior race’ till they became capable of governing themselves? How can any self-respecting nation tolerate such an attitude from an elite clique that is now behaving like a kritarchy?

Trinamool MLA  Abdul Karim Chowdhury questions Mamata’s poor attendance in Assembly

Trinamool Congress MLA Abdul Karim Chowdhury had to face party leadership’s wrath for questioning the limited attendance of West Bengal Chief Minister Mamata Banerjee during Assembly sessions.

Party insiders said that on Tuesday evening, the state Legislative party convened a meeting to update the MLAs about the dos and don’ts when the session is on.

In the meeting, which was chaired by the state president Subrata Bakshi, party veterans stressed on the regular attendance of the MLAs during Assembly sessions, and to attend the meetings of the different standing committees.

During the meeting, Chowdhury — one of the seniormost members of the state — insisted on saying something. When allowed, he said that it would have been better if the chief minister comes to Assembly at an interval of three to four days and stays at least for an hour while the house is in session.

He also referred to his long experience as an elected legislator from Islampur since 1967 where he witnessed former chief ministers like Late Ajay Mukherjee, Late Siddhartha Shankar Ray, Late Jyoti Basu and Buddhadeb Bhattacharjee regularly attending the assembly sessions.

Understanding that the matter can take a serious turn if Chowdhury is allowed to continue, Subrata Bakshi, who was chairing the meeting interrupted and asked him to take his seat without continuing further.

Many of the attending MLAs and ministers present in the meeting were visibly irritated over Chowdhury’s comment, a source in the meeting said.

However, later asked about his comments in the meeting, Chowdhury got into a defensive mood. “I would not want to say what I had said in an internal party meeting. The importance of the Assembly session surely gains more importance on days when the chief minister is present,” he said.

Abdul Karim Chowdhury had been an 11-time elected legislator from Islampur Assembly constituency in North Dinajpur district since 1967.

He was elected as an MLA six times from 1967 to 1982. After that, he got elected from the same constituency in 1991, 1996, 2001, 2011 and 2021.

कौन से वह क़ानून हैं जिनकी जानकारी ‘लव जिहाद’ से भ्रमित हो मुस्लिम से निकाह करने वाली हर हिंदू लड़की को होनी चाहिए

भारत में जहाँ एक तरफ ‘अंतर-धार्मिक’ विवाह बढ़ रहे हैं, वहीं दूसरी ओर लव जिहाद के चंगुल में फंसा कर हिन्दू युवतियों के साथ अवैध निकाह और धर्मान्तरण के मामले भी देखने को मिल रहे हैं। इन दोनों ही मामलों में, विशेषकर हिन्दू युवतियों के लिए दूर मजहब या रिलिजन में विवाह करने से पहले कुछ कानून और अधिकारों को जानना महत्वपूर्ण है। उन्हें यह समझना चाहिए कि यदि विवाह सफल नहीं होता है उनके भविष्य पर क्या प्रभाव होगा, और यह उनकी विरासत को कैसे प्रभावित कर सकता है।

हाल ही में, एक 30 वर्षीय गुजराती जैन लड़की (उसका आभासी नाम निया समझ लीजिये, वह एमबीए-फाइनेंस की पढ़ाई कर चुकी है) ने अपने एक बहुत ही निजी विषय पर चर्चा करने का अनुनय किया । उसने कहा कि वह एक सुन्नी मुस्लिम सहकर्मी के साथ प्रेम-सम्बन्ध में है और दोनों गंभीरता से शादी करने पर विचार कर रहे हैं। वह एक रूढ़िवादी गुजराती परिवार से आती है, उसके माता-पिता इस प्रेम सम्बन्ध के विरुद्ध हैं, लेकिन उसे लगता है कि एक बार विवाह हो जाएगा तो वह उन्हें समर्थन दे देंगे।

वहीं दूसरी ओर मुस्लिम लड़के के माता-पिता इस सम्बन्ध से खुश हैं, लेकिन वह चाहते हैं कि युवती विवाह के समय धर्मांतरण कर मुस्लिम मजहब अपना ले। उन दोनों का इस्लामिक रीति से निकाह हो, ताकि उनके रिश्तेदार और समाज के लोग भी खुश रहे। वह युवती इस विषय पर कानून को जानने के बाद एक सूचित निर्णय लेना चाहती थी ताकि उसके हित सुरक्षित रहें।

मैंने निया से कहा कि एक वकील के रूप में मैं उसे इस विषय से सम्बंधित सभी कानून, उनके लाभ हानि आदि के बारे में बताने का प्रयत्न करूंगा। चूंकि यह एक दिलचस्प विषय था, इसलिए मैंने हमारी बातचीत को प्रश्न उत्तर प्रारूप में बदलने और इसे साझा करने का निर्णय लिया है। यह आम लोगों को निहित स्वार्थ वाले लोगों द्वारा फैलाई गई गलत सूचना का शिकार बनने से रोकेगा।

मैं जितना संभव हो सकेगा, उतना तथ्यात्मक (क़ानून पर आधारित) विश्लेषण करने का प्रयास करूंगा। हालांकि यह ध्यान रखे जाने योग्य बात है कि हर कानून को विभिन्न व्याख्याओं के आधार पर समझाने का प्रयास किया जाएगा। मेरा उद्देश्य मात्र सूचना को प्रेषित करना है, क्योंकि मेरा मानना है कि जब हम सूचना पर आधारित निर्णय लेते हैं, तब हमे बेहतर परिणाम मिलते हैं, और हम विपरीत परिस्थितियों ने निपटने में सक्षम हो पाते हैं।

मेरा और निया का साक्षात्कार

निया – मेरी स्थिति में, शादी करने के अलग-अलग तरीके क्या हैं?

उत्तर – ऐसे में आपके सामने 3 तरीके हैं जिनसे आप विवाह कर सकती हैं। एक, विशेष विवाह अधिनियम के अंतर्गत है जहां न तो आप और न ही आपके पति धर्म परिवर्तन करते हैं और आप दोनों को विवाह में समान अधिकार प्राप्त होते हैं। दो, मुस्लिम कानून के तहत है जहां आपका निकाह होगा, लेकिन उसके लिए पहले आपको मुसलमान बनना होगा क्योंकि निकाह सिर्फ मुसलमानों के बीच ही हो सकता है। जब आप अपना धर्म बदलते हैं तो आपका नाम भी बदल जाता है।

हालाँकि, आप चाहें तो अपने नाम का उपयोग करना जारी रख सकती हैं, जैसा कुछ फिल्म अभिनेत्रियों ने किया है। उदाहरण के लिए शर्मिला टैगोर ने निकाह के पश्चात मजहब बदला और उनका नाम आयशा बेगम रखा गया, लेकिन उसके पश्चात भी उन्होंने अपने असली नाम का उपयोग करना जारी रखा। वहीं तीसरे तरीके में आपके होने वाले पति हिंदू धर्म को अपना सकते हैं, उसके पश्चात आप दोनों की हिंदू विवाह अधिनियम के अंतर्गत विवाह हो सकता है। लेकिन ऐसे उदाहरण देखने को नहीं मिलते हैं, इसलिए यह तरीका असंभव सा ही है।

निया – अगर मैं इस्लाम कबूल करती हूं तो मुझ पर कौन से कानून लागू होंगे?

उत्तर – एक बार इस्लाम मजहब अपनाने के पश्चात आप मुस्लिम पर्सनल लॉ द्वारा शासित होंगी। यह कानून मुस्लिम पर्सनल लॉ (शरीयत) एप्लीकेशन एक्ट, 1937 द्वारा लागू किया गया है।

नियामुस्लिम पर्सनल लॉ के तहत मेरे और पति के क्या अधिकार होंगे?

उत्तर – मुस्लिम पर्सनल लॉ (शरीयत) एप्लीकेशन एक्ट, 1937 बहुविवाह की अनुमति देता है जिसका अर्थ है कि आपका पति चार निकाह कर सकता है और एक ही समय में चार पत्नियाँ रख सकता है। एक पत्नी के रूप में, आप अपने पति को तीन अन्य महिलाओं के साथ साझा करने का विरोध भी नहीं कर सकती हैं।

मैं आपको विचलित नहीं करना चाहता, और संभव है कि आपके पति पूरा जीवन आपके साथ बिताएं। लेकिन जहाँ तक इस्लामिक कानून की बात है, आपके पति आपको कभी भी तलाक कर सकते हैं। इसके अतिरिक्त मुस्लिम पर्सनल लॉ के अंतर्गत होने वाला निकाह एक अनुबंध ही होता है। इसके निश्चित नियम और शर्तें हैं, जिनका पालन कर के निकाहनामा बनाया जाता है। हालांकि निकाहनामे को शरीयत कानून ने आज तक संहिताबद्ध नहीं किया है।

निया – शरीयत क्या है?

उत्तर – शरीयत या शरिया का अर्थ मुसलमानों को शासित करने वाला कानून है। यह संहिताबद्ध नहीं है और इसके प्रावधान अस्पष्ट और अपरिभाषित होते हैं। इसके अतिरिक्त, इसमें कई इस्लामी संप्रदायों में एकरूपता का अभाव है। मुख्य रूप से शरीयत की व्याख्या विभिन्न संप्रदायों के मौलवियों द्वारा समय-समय पर जारी किए गए “हुकुम” और “फतवों” पर आधारित है।

निया – निकाहनामा क्या है? निकाहनामा में निहित नियम और शर्तें क्या हैं?

उत्तर – निकाहनामा का कोई मानक प्रारूप नहीं है। यह ज्यादातर लड़कों की तरफ से मौलवी और मुल्लाओं द्वारा एकतरफा तरीके से तैयार किया जाता है। इन अनुबंधों में विवाह के समय भुगतान किए जाने वाले मुआवजे “दहेज” और तलाक पर भुगतान किए जाने वाले “मेहर”, विरासत के अधिकार आदि से संबंधित खंड सम्मिलित हैं।

निया – अगर हम हिंदू कानून और दूसरे विशेष विवाह अधिनियम के अंतर्गत शादी करते हैं मेरे पति द्वारा एक से अधिक पत्नियां रखने से संबंधित कानून क्या है?

उत्तर – अगर आपके पति हिन्दू बन जाते हैं, तो आप दोनों हिंदू विवाह अधिनियम के अंतर्गत विवाह कर सकते हैं । चूंकि यह विवाह ‘विशेष विवाह अधिनियम’ के अंतर्गत हुआ है, तो आपके पति कानूनी रूप से एक से अधिक पत्नी नहीं रख रखते। हिन्दू धर्म में बहुविवाह वर्जित है, अगर आपके पति आपको तलाक दिए बिना दूसरी शादी करने का प्रयास करते हैं, तो उनका दूसरा विवाह अमान्य माना जाएगा। दूसरी पत्नी को विरासत में कुछ नहीं मिलेगा और पहली पत्नी (आप) के अधिकार प्रभावित नहीं होंगे।

निया – हिंदू कानून और विशेष विवाह अधिनियम के अंतर्गत तलाक से जुड़ा कानून क्या है?

उत्तर – यदि आप विशेष विवाह अधिनियम, 1954 के तहत विवाह करते हैं, जहां आप में से किसी ने धर्मांतरण नहीं किया हो, या हिंदू विवाह अधिनियम, 1955 के तहत जहां आपका प्रेमी हिंदू धर्म में परिवर्तित होता है, तो तलाक की प्रक्रिया उक्त कानूनों के प्रावधानों के तहत होगी, जहां केवल परिवार न्यायालय गठित पारिवारिक न्यायालय अधिनियम, 1984 के तहत किसी भी पक्ष के अनुरोध पर आपकी शादी को भंग करने का अधिकार होगा।

न्यायालय के पास आपके विवाह के विघटन के पश्चात भी आपके बच्चों के भरण-पोषण और पति द्वारा भुगतान किए जाने वाले भरण-पोषण के बारे में निर्णय लेने का अधिकार होगा। भरण-पोषण और गुजारा भत्ता न्यायालय द्वारा पति की वित्तीय स्थिति और आय के आधार पर निश्चित किया जाता है।

निया – मुस्लिम कानून के तहत तलाक से जुड़ा कानून क्या है? क्या मैं अपने शौहर को तलाक दे सकती हूं?

उत्तर – मुस्लिम विवाह अधिनियम, 1939 का विघटन उन परिस्थितियों से संबंधित है जिसके तहत मुस्लिम महिलाएं तलाक दे सकती हैं। इसके अतिरिक्त वह अपने शौहर से कुछ अधिकार भी मांग सकती हैं। हालांकि इसमें कई प्रकार की सामाजिक समस्याएं भी आती हैं । वहीं पति भी तीन बार ‘तलाक’ शब्द का उच्चारण कर अपनी बीवी को तलाक दे सकता है।

निया – मुस्लिम कानून के तहत पति कैसे तलाक दे सकता है?

उत्तर – भारतीय सरकार और न्यायपालिका ने हाल ही में तीन तलाक कानून को अवैध और दंडनीय माना गया है, लेकिन अभी भी मुस्लिम पुरुष द्वारा तलाक की प्रक्रिया बहुत आसान है। इस कानून के अंतर्गत तीन माहवारी चक्रों के समय तलाक दिया जा सकता है जिसे इद्दत की तीन शर्तों के रूप में जाना जाता है।

अगर पत्नी गर्भवती है तो इद्दत की अवधि उसके बच्चे को जन्म देने तक है। गुजारा भत्ता और पत्नी के भरण-पोषण जैसे बाकी नियम और शर्तें निकाहनामा अनुबंध के प्रावधानों द्वारा शासित हैं। पतियों को एक पूर्व-निर्धारित “मेहर” (तलाक होने पर पति द्वारा पत्नी को देय मुआवजा) देना पड़ता है।

निया – मुस्लिम कानून के तहत मुझ पर और मेरे बच्चों पर तलाक के क्या दुष्प्रभाव हो सकते हैं?

उत्तर – भारत में मुस्लिम महिला (तलाक पर अधिकारों का संरक्षण अधिनियम), 1986, तलाक पर महिलाओं के रखरखाव और गुजारा भत्ता से संबंधित कानून इस विषयों को नियंत्रित करता है। पति के लिए अपनी पत्नी को गुजारा भत्ता देना आवश्यक है, लेकिन केवल इद्दत की अवधि के दौरान, यानी तलाक के 90 दिन बाद। इद्दत की अवधि समाप्त होने के बाद महिला और उसके बच्चों की रखरखाव की जिम्मेदारी उसके माता-पिता के परिवार में वापस आ जाती है।

हालाँकि, अगर महिला के बच्चे बड़े हैं और जीविकोपार्जन करने में सक्षम हैं, तब अपनी माँ की देख रेख करने की जिम्मेदारी उन पर आ जाती है। यदि उसके मायके में कोई अन्य व्यक्ति नहीं है जो उसका भरण-पोषण कर सके और तब मजिस्ट्रेट, जहां भरण-पोषण के लिए उसका आवेदन लंबित है, राज्य वक्फ बोर्ड को उसके द्वारा निर्धारित भरण-पोषण का भुगतान करने का निर्देश दे सकता है।

निया – हिंदू कानून और विशेष विवाह अधिनियम के तहत मेरे और मेरे बच्चों पर तलाक के क्या परिणाम होंगे?

उत्तर – अगर आपके पति हिन्दू धर्म अपना लेते है, या आप हिन्दू विशेष विवाह अधिनियम के अंतर्गत विवाह कर लेते हैं, तो तलाक की प्रक्रिया अलग होती है। तलाक हिंदू विवाह अधिनियम, 1955 की धारा 13 के प्रावधानों के तहत प्राप्त किया जा सकता है, प्रावधान पति और पत्नी दोनों के लिए समान हैं।

विशेष विवाह अधिनियम, 1954 की धारा 27 के तहत पति या पत्नी में से किसी एक द्वारा तलाक के लिए याचिका दायर की जा सकती है या अधिनियम की धारा 28 के तहत आपसी सहमति से तलाक की याचिका दायर की जा सकती है। एक निश्चित कानूनी प्रक्रिया का पालन करने के पश्चात तलाक लिया जा सकता है। इस प्रक्रिया के पश्चात पति को अपनी पत्नी और बच्चों को एक निर्धारित राशि भरण-पोषण के लिए लम्बे समय तक देनी पड़ती है।

निया – अगर मैं इस्लाम में परिवर्तित हो जाऊं और शरीयत के तहत शादी कर लूं तो मेरे लिए विरासत के क्या नियम हैं?

उत्तर – पत्नी को अपने पति की मृत्यु पर उसकी संपत्ति का 1/8 भाग प्राप्त होता है यदि उनके बच्चे हैं। अगर शादी से कोई संतान नहीं होती है, तो वह संपत्ति के 1/4 हिस्से की अधिकारी होती है। वहीं आपकी बेटी को बेटे का आधा हिस्सा मिलेगा। पत्नी की मृत्यु होने पर पति को उसकी संपत्ति का 1/4 भाग प्राप्त होगा यदि उनके बच्चे हैं। अगर शादी से कोई संतान नहीं होती है तो वह आधी संपत्ति का हकदार होता है। पुत्र को पुत्री से दुगना भाग प्राप्त होता है।

एक मुस्लिम मां अपने बच्चों से विरासत का अधिकार पाने की हकदार है। अगर उसके बेटे की मृत्यु हो चुकी है, लेकिन उसका परिवार है, तब भी वह अपने मृत बेटे की संपत्ति का छठा भाग पाने की पात्र है। पोते-पोतियों की अनुपस्थिति में उसे एक तिहाई हिस्सा मिलेगा। हालाँकि, वह अपनी संपत्ति का एक-तिहाई से अधिक हिस्सा नहीं दे सकती है और यदि उसका पति एकमात्र वारिस है, तो वह संपत्ति का दो-तिहाई हिस्सा वसीयत द्वारा दे सकती है।

यदि एक हिंदू महिला इस्लाम में परिवर्तित हुए बिना एक मुस्लिम पुरुष से निकाह करती है, तो वह अपने पति की संपत्ति को विरासत में पाने की अधिकारी नहीं होगी क्योंकि मौजूदा कानूनों के तहत विवाह न तो ‘नियमित’ होगा और न ही ‘वैध’ माना जाएगा। महिला वह मेहर की अधिकारी होगी लेकिन वह अपने पति की संपत्ति का उत्तराधिकारी नहीं हो सकती।

हाल ही में सुप्रीम कोर्ट द्वारा तय किए गए एक मामले में यह कहा गया था कि “एक मुस्लिम व्यक्ति का एक मूर्तिपूजक या अग्निपूजक के साथ विवाह न तो वैध (सहीह) है और न ही शून्य (बतिल) विवाह है, बल्कि यह केवल एक अनियमित (फसीद) विवाह है।” ऐसे विवाह (फसीद विवाह) से पैदा हुआ कोई भी बच्चा अपने पिता की संपत्ति में हिस्से का दावा करने का अधिकारी है, लेकिन पत्नी को कोई अधिकार नहीं होता।

निया – अगर हम हिन्दू विशेष विवाह अधिनियम के अंतर्गत विवाह करते हैं तो मेरे लिए विरासत के क्या नियम हैं?

उत्तर – जब एक मुस्लिम हिन्दू विशेष विवाह अधिनियम, 1954 के अंतर्गत शादी करता है, तो वह विरासत के उद्देश्यों को प्राप्त करने का अधिकारी नहीं रहता है। तदनुसार, ऐसे मुसलमान की मृत्यु के बाद उसकी संपत्ति विरासत के मुस्लिम कानून के तहत न्यागत नहीं होती है। ऐसे मुसलमानों की संपत्तियों की विरासत भारतीय उत्तराधिकार अधिनियम, 1925 के प्रावधानों द्वारा शासित होती है और विरासत का मुस्लिम कानून लागू नहीं होता है। हिन्दू विशेष विवाह अधिनियम के अंतर्गत एक अंतर-धार्मिक विवाह करने के पश्चात पत्नी समेत सभी उत्तराधिकारियों के सामान रूप से विरासत मिल जाती है।

निया – मैंने यह शब्द हलाला सुना है, इसका क्या अर्थ है?

उत्तर – इस्लामी कानून के अंतर्गत, एक पति केवल एक ही बार में तीन तलाक (ट्रिपल तलाक) कहकर तलाक दे सकता है। हालांकि हाल ही में तीन तलाक के इस तरीके को गैरकानूनी बना दिया गया है। तलाक का अनुमत तरीका अभी भी लागू है जहां पति महिला के प्रत्येक मासिक धर्म के दौरान तीन बार तलाक का उच्चारण कर सकता है।

तीन तलाक का ‘वेटिंग पीरियड’ समाप्त होने के पश्चात तलाक निश्चित हो जाता है। हालाँकि, यदि युगल तीन तलाक के पश्चात या नियमित तलाक़ के पश्चात पुनर्विवाह करना चाहता है, तो महिला को किसी तीसरे व्यक्ति से निकाह करना पड़ेगा। उसके पश्चात निकाह का उपभोग करने, तलाक लेने और मूल पति से दोबारा निकाह करने की आवश्यकता होगी। इसे तहलील या निकाह-हलाला के नाम से जाना जाता है।

निया – मैं अपने मुस्लिम साथी के साथ विवाह करना चाहती हूं, मेरे लिए सबसे अच्छा विकल्प क्या होगा?

उत्तर – अगर आप अपने मुस्लिम साथी से विवाह करना चाहती है, तो आपका साथ हिन्दू विशेष विवाह अधिनियम के लिए सहमत होना चाहिए। जैसा कि पहले भी कहा गया है, मुस्लिम पर्सनल लॉ के तहत इस्लाम में परिवर्तित किए बिना आपकी शादी “फसीद” यानी अनियमित होगी जिसे केवल आपके धर्म परिवर्तन से ही दूर किया जा सकता है। एक बार जब आप धर्मान्तरित हो जाते हैं, तो सभी देनदारियां और असमानताएं, जैसा कि पहले बताया गया था, चलन में आ जाएंगी।

निया – अगर मैं आपके द्वारा सुझाए गए विशेष विवाह अधिनियम के अंतर्गत अपने मुस्लिम मित्र से विवाह करती हूं तो मुझे किस तरह की समस्याओं का सामना करना पड़ सकता है?

उत्तर – निया, मैंने आपको कानून के प्रावधानों के आधार पर सलाह दी है। यह आप पर है कि आप इन प्रावधानों पर सावधानीपूर्वक विचार करें। यहां तक ​​कि अगर आप विशेष विवाह अधिनियम के तहत शादी करते हैं, तो आप पर धर्मांतरण के लिए बहुत दबाव डाला जा सकता है। मैं आपके मुस्लिम मित्र से नहीं मिला, हो सकता है वह अच्छा लड़का हो और आधुनिक भी हो।

लेकिन अब कहानी में आता है बदलाव

निया ने यह प्रश्न अपने मुस्लिम मित्र को बताये, और यह सब जानकारी मिलने के पश्चात वह भी विशेष विवाह अधिनियम के अंतर्गत विवाह करने के लिए मन करने लगा। उसने कहा कि उसका परिवार इस प्रस्ताव से सहमत नहीं है। उसने निया को कहा कि इस सम्बन्ध में भरोसा होना चाहिए, और ऐसे प्रश्न कर उसके प्रेम पर किसी प्रकार का संदेह नहीं करना चाहिए।

मुस्लिम युवक ने निया को ‘नाममात्र’ के लिए धर्मांतरण करने को कहा, और यह भी आश्वासन दिया कि वह पहले के प्रकार ही अपने धर्म और संस्कृति का पालन जीवनपर्यन्त करने के लिए स्वतंत्र होगी। उसने निया को कहा कि वह स्वयं निकाहनामा का मसौदा तैयार करवा सकती है, लेकिन उन्हें अंततः निकाह ही करवाना पड़ेगा।

ऐसी कड़ी शर्तें सुन कर निया ने यह विवाह रद्द करने का निर्णय लिया। जब उसने मुझे अपना यह निर्णय सुनाया तो वह दुखो हो कर रो रही थी। मैंने उसे समझाया कि आजीवन रोने से अच्छा है अभी ही रो लिया जाए । एक वकील के रूप में, मैं केवल एक सलाहकार हूं, अंतिम निर्णय आपने लिया है, और मुझे आशा है आप अब एक अच्छा जीवन व्यतीत कर पाएंगी।

Addressing a public meeting in Ahmedabad for a BJP candidate ahead of next month’s Assembly elections in Gujarat, Assam Chief Minister Himanta Biswa Sarma said on Tuesday that nowadays Rahul Gandhi looks like Saddam Hussein, the deceased Iraqi dictator.

Questioning Rahul Gandhi’s few visits to Gujarat ahead of the elections, Sarma said, “He is invisible in Gujarat. He comes to the state like a visiting faculty… He also did not campaign in Himachal Pradesh. He is visiting only those places where there are no elections… May be because he is scared of defeat.”

The Assam Chief Minister also alleged that the Congress must have paid Bollywood stars to join Rahul Gandhi’s Bharat Jodo yatra, in an indirect reference to actors Pooja Bhatt and Amol Palekar who had joined the Yatra.

Earlier in the day while addressing a public meeting in Dhansura, Sarma called for stringent laws to curb love jihad/grooming jihad, pointing out that during interrogation, Aftab Ameen Poonawalla, who brutally murdered his live-in partner Shraddha Walkar in Delhi’s Mehrauli area, had reportedly said that he was dating only Hindu girls because they were emotional.

Rahul Gandhi has been launched several times over the last 2 decades by Congress handlers to establish him as the successor of the Nehru-Gandhi dynasty and ‘future of Indian politics’. A video after the 2009 LS elections shows the excitement in the Lutyens’ media and bureaucratic cabal and how Rahul Gandhi was being heralded by the likes of Shekhar Gupta, NK Singh, Prannoy Roy, Vir Sanghvi –

“One – he reminded me of his father who when pushed to the wall could be combative, drop soundbites. But when he was comfortable, was humble, graceful, gracious..that is the Rahul Gandhi we saw today, paying tribute to Advani, seeming very measured, seeming very mellow…Point 2- he said something about the youth, I think that is going to be the theme of the Congress, the victory of young India…Third – there are many questions about reform. I think he made it very clear that he is very much an Aam Aadmi man, his priority is not going to be corporate fatcats, its going to be the poor of India:” ‘journalist’ Vir Sanghvi who was outed just a few months later via the Radia Tapes expose as being a shill for the same ‘corporate fatcats’.

Unfortunately, the potential which the durbari media claimed to have identified in Rahul Gandhi never materialized, and he has proven to be utterly incapable of leading his party or even talking coherently on any topic. Moreover, his frequent secretive foreign trips and constant undermining of Bharat and demonization of its people, indicate that he is now acting as a rogue agent for foreign powers.

In between, there was an attempt to project his sister Priyanka Vadra, but that too has fizzled out after she failed miserably at turning the party’s fortunes around in UP. So the party is now back to promoting Rahul Gandhi. In order to counter the ‘pappu’ (immature, unformed person; small boy) moniker which has stuck to him, political analysts believe that Congress handlers have decided to relaunch him with a bearded look to presumably lend more gravitas.

Govt punches holes in global indices ranking Bharat poorly on democratic parameters

The government on Tuesday raised serious doubts over a clutch of studies, which have indicated that Bharat’s rankings have declined on a number of global-based indices like democracy, freedom, civil liberties and political culture among others, in recent years.

Indices like Freedom in the World Index, V-DEM indices and EIU Democracy Index have placed Bharat at the same level as during the Emergency of the 1970s.

Moreover, Bharat has been placed below countries like Northern Cyprus.

The government has termed these as “perception-based indices”.

In its defence, the government has said that independent Bharatiya think tanks should be encouraged to do similar perception-based indices for the world in order to break the monopoly of a handful of western institutions.

There are serious problems with the methodology used in these perception-based indices. First, these indices are primarily based on the opinions of a tiny group of unknown “experts”, the government has said.

It has come out with a working paper titled “Why India does poorly on global perception indices”, which is part of a working paper series prepared by the prime minister’s economic advisory council (PMEAC), where it has raised questions about the methodology used by the three indices.

The paper is a point by point analysis of the methodology used by the three indices.

On being placed below countries like Northern Cyprus, the working paper says: “The Freedom in the World report has given the territory of Northern Cyprus a score of 77 which makes it a free democracy. This is a territory only recognised by Turkey, not even by the United Nations. Meanwhile, the think-tank continues to treat Jammu and Kashmir as a separate territory since the early 1990s and now places it in the category of ‘not free’.”

In a series of tweets, the PMEAC on Tuesday, it said that “the questions that are used by the indices are subjective and are worded in a way that is impossible to answer objectively even for a country, let alone compare across countries…. There are questions that should be asked but are excluded”.

“Certain questions used by these indices are not an appropriate measure of democracy across all countries,” the PMEAC tweeted.

Since these indices are inputs into the World Governance Indicators, the World Bank should ensure greater transparency and accountability from these institutions, the PMEAC further said.

“Meanwhile, independent Indian think tanks should be encouraged to do similar perception-based indices for the world in order to break the monopoly of a handful of western institutions,” it noted.

“The first index in this paper is the Freedom in the World Index which has been published since 1973 by Freedom House. India’s score on Civil Liberties was flat at 42 till 2018 but dropped sharply to 33 by 2022; that for Political Rights dropped from 35 to 33. Thus, India’s total score dropped to 66 which places India in the ‘partially free’ category – the same status it had during the Emergency,” the paper has noted.

Since the publication of the index, the only two previous instances where Bharat was considered as Partially Free was during the time of emergency and then during 1991-96 which were years of economic liberalisation. Clearly, this seems very arbitrary as what did the period of emergency which was a period of obvious curtailment of various activities had similar to the period of economic liberalisation or of the current times, the PMEAC working paper has noted.

On the second index, the working paper said: “The second index we look at in this paper is the Economist Intelligence Unit (EIU) Democracy Index. This index is published by EIU, which is the research and consulting arm of the firm that publishes the Economist magazine. India is placed in the category of ‘Flawed Democracy’ and its rank deteriorated sharply from 27 in 2014 to 53 in 2020 and then improved a bit to 46 in 2021. The decline in rank has been on account of decline in scores primarily in the categories- Civil Liberties and Political Culture. The maximum decline has been in the category Civil Liberties, for which the score declined from 9.41 in 2014 to 5.59 in 2020. In the same time period, India’s score for Political Culture declined from 6.25 to 5.0. India’s rank then recovered marginally to 46 in 2021, primarily on grounds that the government rolled back farm-sector reforms, which lead to improvement in scores on the categories – Civil Liberties, Functioning of Government and Political participation.”

EIU in their methodology mention that they do not only rely on opinion of experts but also take responses for some questions from opinion polls, if available {primarily from World Value Survey (WVS)}. If the responses from opinion polls are not available, then the responses for those questions also are answered by experts. In case of Bharat, the latest available WVS report is of 2012. The latest round of Wave 7 (2017-2020) has not been conducted for Bharat yet. This implies that score of EIU Democracy index for Bharat is based only on expert opinion since 2012, the PMEAC says in the working paper.

“A time series analysis of the V-DEM scores show that India does well on objective parameters such as share of population with suffrage, but scores on various subjective sub-indices have declined sharply since 2014,” the paper concludes.

Married Yunus Pasha (25) grooms minor Hindu girl (13) after gifting mobile, blackmails and rapes her, was forcing her to convert to Islam: K’taka

Yunus Pasha, a 25-year-old married man, groomed a minor (13) Hindu girl and forced her to strip during a video chat and recorded her intimate photo/video; he later entered her home after forcing her to give sleeping pills to her grandmother and raped the minor. Later, he started pressurizing her to convert to Islam.

Karnataka police on Wednesday arrested a man on charges of making obscene videos of a minor Hindu girl aged 13 years, blackmailing and raping her. The arrested person has been identified as 25-year-old Yunus Pasha.

According to police, Yunus Pasha, a married man, had befriended the minor girl and gifted her a mobile phone.

Later, he started talking to her over the phone and forced her to strip before the camera and captured her nude photos and videos. On November 11, the accused barged inside the girl’s residence in Mandya district when she was alone with her grandmother.

He threatened to share her private videos and photos on social media and asked her to give sleeping pills to her grandmother. When the woman slept off, the accused raped the victim.

On returning home, the girl’s parents observed strange behavior of the girl. When they questioned her, the minor broke down and narrated her ordeal. Later, they lodged a police complaint in this regard.

Preliminary inquiries revealed that Pasha was forcing the girl to convert to Islam. Even after raping, the man tortured the minor to get converted to his religion. He also offered to ‘marry her’ if she embraces Islam, police said.

Further investigation in the matter is on.

The Islamization of key positions and the repeated humiliation of Hindu intellectuals in Fiji flies in the face of PM Bainimarama’s defense

In our previous article, we exposed the blatant takedown of Hindu intellectuals in Fiji and the practice of slamming them with false cases [1]. In reply to that article, Fiji’s Prime Minister Bainimarama upheld the secular credentials of Fiji, saying there is ‘equal opportunity for all’ in Fiji irrespective of ethnic or religious identity [2]. However, the stuffing of key positions in the Fijian government with Muslims and Pakistani-origin people undermines such claims.

Simultaneously, the takedown of Hindu leaders and intellectuals, often coinciding with Diwali and the involvement of Pakistan in the conduct of the elections with allegations of fraud itself manifests a pattern that is way too concerning. It smells of Islamization. Coupled with the fact that allegations of corruption amounting to billions of dollars are rife, it fits into a pattern that can lead to the compromise of the Fijian nation itself. 

Ever since Aiyaz Sayed-Khaiyum won the support of Prime Minister Frank Bainimarama by helping him to win elections allegedly with the help of Pakistan, he has embarked on an ambitious Islamization drive. Because the Muslim population in Fiji is small, he has carefully chosen a path where key positions in the government have been stuffed with Muslims without assuming outright power. Even Pakistani-origin professionals have been called in to help in that effort. A case in point is Saud A Minam, a former citizen of Pakistan who was vying to be the CEO of Fiji National Provident Fund. Presently the CEO of Fiji Development Bank, his Fijian citizenship remains quite controversial. It is said that rules were flouted to ensure that he gets the early citizenship of Fiji [3,5].

While a MOU between the Pakistan Chamber of Commerce and Fijian Chamber of Commerce, resulting in the formation of the Pakistan Fiji Business Council may appear business as usual, but when we couple it with the fact that the help of NADRA, a Pakistani company, with questionable past connected to terrorism, was asked to manage Fiji’s 2018 election system, a new paradigm and pattern emerges. Understanding the fact that Pakistan itself is on the verge of bankruptcy, the context sees something more than what meets the eye [6-9].

The literal stuffing of Muslims in key positions of power, vis a vis the systematic takedown of Hindu intellectuals, forces the Hindus to see a clear communal aspect to the entire development. This runs contrary to what Prime Minister Bainimarama has said in his response to the HinduPost article, where he says that “Fijians irrespective of religion, work together to build the country”.

As one looks at the appointments in key positions, one is aghast to see an outsized Muslim presence, despite forming only 5% of the population. While all these could have easily been seen as hard-working professionals making their way up in this multi-religious, multi-ethnic nation, the connections with Pakistan, questionable appointment of Pakistani nationals and alleged subversion of law to fast track citizenships raises doubts and concern.

Following are some of the key appointments made by Khaiyum as AG

1. Reserve Bank Governor [10]: – Faizul Ariff Ali. He holds numerous other board positions.

2. Fiji Financial Intelligence Unit [11]: – Razim Buksh

3. CEO of Fiji Accident and Compensation Commission [12]: Parvez Akbar

4. Fiji Broadcasting Commission [13]: – Riyaz Sayed-Khaiyum – holds other various board appointments. He was the Chairman of Air Terminal Services (ATS) whereby he charged $5000 per day whilst workers were protesting during the strike in early 2018.

5. Lead Consultant and Accountant on any Foreign Investment in Fiji, aunt of Khaiyum [14]:  – Nur Bano Ali. There are allegations of corruption against her. For example, she was awarded a contract of $500,000, without any tender process, by her nephew Khaiyum, for the restructure of Rewa Dairy. When the Office of the Auditor-General highlighted this in their report, Nur Bano Ali cried defamation but she lost the case. She also allegedly supported the misdemeanors of male bosses against their female employees. In addition, Nur Bano holds the position of Chairperson of Fiji National University (FNU) Council and the Chairperson of Women in Business (Fiji) and also controls the Fiji Chamber of Commerce. Nur Bano allegedly also wields and misuses her tremendous influence and authority in the Fijian private sector.

6. CEO of Pacific Fishing Company [15-16]: – Saiyad Raiyum

7. Pakistani born Gul Fatima and the lawyer for Attorney-General Aiyaz Sayed-Khaiyum [17-19]. Gul Fatima leads the case where politically-motivated charges have been brought against Richard Naidu, one of Fiji’s top lawyers and a political rival of Khaiyum. Khaiyum brought up the trumped-up charges against Richard Naidu whilst Gul Fatima is representing Khaiyum in this case.

8. FICAC -Fiji Independent Commission against Corruption Commissioner [20]: – Rashmi Aslam

9. Most importantly the Supervisor of Elections in Fiji [21]: – Mohammed Saneem.

10. Permanent Secretary for Commerce, Trade, Tourism and Transport ( Govt)  – Shaheen Ali

11. Minister for Women, Children and Poverty Alleviation – Rosy Akbar

12. Minister for Ministry of Commerce, Trade and Tourism [22-23]: – Faiyaz Siddiq Koya

13. Fiji Airways Executive General Manager – Shaenaz Voss. Shaenaz is allegedly the real boss in Fiji Airways who controls both Fiji Airways and Airports Fiji Limited.

14. Former Executive Chairman of Fiji Sugar Corporation (2011-2016) – Abdul Khan. Abdul Khan is alleged to have single handedly destroyed the sugar industry through corruption and financial mismanagement as he was getting $750,000 yearly salary plus rental free apartment in Denarau Nadi. He was both the CEO and Chairman of FSC which is a blatant conflict of interest. He was forced to resign after being exposed by NFP Leader Dr. Biman Prasad and Fiji Labour Party Leader Mahendra Chaudhry. Despite NFP Leader Dr. Prasad raising issues many times in Parliament about investigations against Abdul Khan, Sugar Minister Bainimarama always dodged and evaded the question. Khaiyum has protected Abdul Khan since he donated $200,000 towards FijiFirst Party [24].

15. Former Executive Chairman of Airports Fiji Limited – late Faiz Khan. He got around $800,000 in yearly salary and held numerous other board positions.

16. Fiji National Provident Fund (FNPF) Board Member – Mukhtar Ali. He’s a cousin of Khaiyum who resides in the United States of America. Imagine sidelining the locals, and appointing his cousin who lives overseas.

17. Mahmood Khan – Khaiyum’s uncle who used to reside in New Zealand holds the positions of University of the South Pacific’s Council Member, Board Member of Fiji Revenue and Customs Services (FRCS) and Board Member of Fiji National Provident Fund. This is a case of blatant conflict of interest. This is the same Mahmood Khan who was instrumental in trying to get rid of USP Vice Chancellor Prof. Pal Ahluwalia by campaigning against him. 

The Islamization of Fiji is continuing unabated. On one hand, the immigration from Pakistan, and on the other hand the official patronage being provided to Muslims and Islamic institutions. While attendance of politicians in any religious festival is a way to connect, the costumes of the people attending these events resembles a culture alien to Fiji [25-29].

On the other hand, when we consider the takedown and humiliation of Hindu intellectuals – selectively targeted, slammed with false cases, it will disturb any objective observer. It shows a sinister plot to disrepute the Hindu community. This is a ploy often implemented in many Islamist nations where Hindus have been hounded and marginalized, and left leaderless and disorganized. Pakistan is notorious for its Islamofascist state and society, where all minorities like Hindu, Christian, Sikh, Ahmadi, Shia are systematically persecuted. Is this the type of country that Fiji should be looking to engage and import people from?

Even Diwali day, the most important festival for Hindus, is being targeted and cases emerge where Hindu intellectuals had to stop their Diwali puja midway to comply with the government diktats.

Take for example, NFP leader Professor Biman Prasad. He was slammed with a false, fabricated, malicious case. The CID wanted to interview him on Wednesday. He requested a postponement by one day, saying that he be allowed to complete his Diwali prayers. The CID arrived in the morning, while he was doing his Diwali puja at home. He had to stop his puja and rush to the NFP headquarters where the CID was waiting [30].

Another Hindu intellectual who was dismissed on a Diwali day is Sharvada Sharma. In his capacity as the Solicitor-General for 10 years, he loyally served Aiyaz Sayed-Khaiyum. When Khaiyum lost the initial court case that he brought against former SODELPA MP Niko Nawaikula, he blamed it on Sharvada.

Critics believe that Khaiyum then made the following plan: First he used PM Bainimarama to demand Sharvada should resign. Sharvada refused to resign and resisted the bullying attempt. Next Khaiyum used Elections Supervisor Mohammed Saneem to lodge a complaint against Sharvada which got him dismissed. With links to Pakistan, people in Fiji see this as a case of the Islamist brotherhood ganging up against a Hindu. 

Sharvada was given the dismissal letter on Diwali day in 2021 last year when he was about to do his main pooja in the evening. Sharvada felt deeply humiliated being given the dismissal letter by Khaiyum’s men when he was about to do Diwali Pooja. Although Sharvada has filed a court case, the judiciary is seen as dragging the case continuously, which is against the 2013 constitution.

Under the 2013 constitution, only the Chief Justice and President can dismiss the Solicitor-General but in this case Khaiyum and Saneem got rid of a top devout Hindu like Sharvada. This points to how judiciary and justice system have all been weakened by Khaiyum and his cabal. [31-33].

Another example is Parmesh Chand. He was one of the best Permanent Secretaries in the Bainimarama Government. He also served as a PS in the late Laisenia Qarase’s government. As Permanent Secretary for the Public Service Commission (PSC), he worked under Bainimarama who was the Minister for Public Service Commission. Since Bainimarama knew nothing about the ministry, Parmesh handled the responsibilities of PSC and his ministry very diligently. He also regularly appeared on TV and in the media on issues relating to public service. This was before the 2014 elections.

After the 2014 elections, Khaiyum became the Minister for Public Service Commission. Subsequently, Parmesh Chand’s appearance in media and TV began to decline. Reliable sources confirm that Khaiyum continuously interfered with Parmesh Chand when he was only doing his duty. Khaiyum wanted all control under him and wanted Parmesh to do what he was told to do. Khaiyum also saw Parmesh as a threat because Bainimarama used to like Parmesh’s work.

It is alleged that Khaiyum then began to scheme against Parmesh by badmouthing him to Bainimarama. In 2015, media reports said that Parmesh had left the government but in reality, Parmesh was forced to resign by Khaiyum. Parmesh could not survive even one year under Khaiyum’s ministry. A top PS, and a Hindu, like Parmesh was forced out by Khaiyum because he was seen as a threat since he knew lots about public service and reforms. After Parmesh was gone, Khaiyum turned PSC into the Ministry of Civil Service and later destroyed the independence of the organization. Analysts says that the Civil service ministry now only does what Khaiyum orders them to do when previously it was an independent body [34].

Dr. Neil Sharma diligently served as one of the top Health Ministers in the Bainimarama Government from 2009-2014. After winning his seat in the 2014 elections, Dr. Sharma was not included in the cabinet by Khaiyum. Sources claim that Khaiyum was influenced by top FijiFirst donors not to give the health portfolio again to Dr. Sharma because he was strict when it came to food production and its quality.

In 2015, NFP Leader Dr. Biman Prasad brought a motion to Parliament whereby he called for an increase in health budget to address the rising Non-Communicable Diseases (NCD) cases in the country. It was a very good motion and as former Health Minister, Dr. Sharma knew its importance and so voted in favour of the NFP motion. Then Leader of the House, Pio Tikoduadua (now NFP President) sorted this issue out with Bainimarama and all was okay since Dr. Sharma was asked to vote along party lines next time. But Khaiyum got angry and wanted Dr. Sharma out.

Bainimarama had no option but to listen to Khaiyum and on his demand, forced Dr. Sharma to resign. Feeling humiliated at his intervention being ignored, Pio Tikoduadua also resigned. Hence, it is believed that because of Khaiyum’s arrogance, FijiFirst lost two good and capable people like Tikoduadua and Dr. Sharma. [35].

There have also been severe allegations of institutionalized corruption under Khaiyum.  For example, buying of Aircrafts by Fiji Airways was mired in controversy with the formation of a Shell company Waqavuka Financing Limited. It was meant to facilitate the purchase of three aircrafts, but the details have been murky. Dr. Biman Prasad of NFP has asked for details of the shell company, transactions involved and has questioned the acquisition process [36].

Another questionable transaction is the sale of 44 % of Energy Fiji Limited to a consortium, Sevens Pacific Pte. Limited. The earnings of the sale, which should easily have been more than USD 200 million, was never transparent, raising the specter of massive corruption [37]. Even the acquisition of 75% of Grand Pacific Hotel by Fiji National Provident Fund from Papua New Guinea partners – National Superannuation Fund and CGA Properties Limited – in November 2018, also was not free of controversy [38].

Another disturbing fact is the attempt by Khaiyum to sever the umbilical cord of Fijian Hindus with Bharat (India). While every Hindu reveres the place they work as Karmabhoomi (land where they work and which sustains them) and does everything possible to make the nation strong, Bharat remains a Punyabhoomi (sacred land, spiritual home) for all Hindus. Efforts are on to remove pure Hindi from Fiji and replace it with locally spoken Hindi. This is being done through the Fiji National Radio such as Radio Mirchi under Fijian Broadcasting Corporation with the backing of Khaiyum brothers, namely Aiyaz and Riyaz. The goal here is to carve out a separate identity for the Hindus of Fiji and make them vulnerable and disorganized so that they are cut off from the global Hindu population [39-43].

Under the prevailing situation, as Fiji goes to the polls, for the betterment of Fiji, a corruption free government which is free of bias is one that is for the good of all Fijians. Voters can decide what kind of leadership can provide such ideal governance, something that Hindus refer to as ‘Ram Rajya’.

TN: Man abuses & threatens to attack Brahmins for reciting Sanskrit mantras

A shocking video of a man, presumably a Dravidianist or Tamil nationalist, threatening Brahmin pujaris for reciting mantras in Sanskrit has emerged on the internet. The man threatens to pelt stones at the Brahmins if they don’t recite mantras in Tamil despite the locals opposing it.

In a video going viral on social media, a man can be heard shouting at Brahmins asking them to recite mantras in Tamil. It appears to be a consecration ceremony of a temple where many yajna kundas can be seen. The man appears to be in a drunken state and cannot even pronounce Tamil correctly. But he keeps threatening the Brahmins at yagya kundas to recite mantras in Tamil even after they assured him that they will give explanation to all the mantras in Tamil after the recital is over.

Locals can be seen standing in support of Brahmins and trying to assuage the drunkard at first. They also invite him to remove his chappals and sit along with them to hear the recital and the explanation. From the tone of the locals it appears that the man is from a political background with considerable influence. Funnily he suggests that the pujaris should say “Vinayaka Potri” which he thinks is pure Tamil.

In the end after he repeatedly harassed the pujaris saying, “I’ll call whoever I need to. I don’t worry about repercussions. I’ll throw stones at you if you don’t say it in Tamil”, locals ask “Are you the only Tamil in the village? Are others not Tamils?”. The authenticity of the video and when it was recorded or posted on social media first could not be independently verified by Hindu Post. But such incidents have been on the rise since DMK came to power with Dravidian ideologues openly calling for violence against Brahmins.

Last month Dravidar Kazhagam leader Suba Veera Pandiyan had abused Badri Seshadri, a Tamil Brahmin scholar and threatened to cut off the janeus of Brahmins. Seshadri had commented on late CM Annadurai’s remark about Hindi. A Dravidianist had tweeted that Annadurai said that Hindi can be learnt in six months and there is nothing more in the language to learn after that. Seshadri had quoted this and said that Annadurai should be called an idiot if he had really said so.

Dravidianists descended on his TL abusing him and his caste for proposing that Annadurai should be called an idiot. They also demanded the DMK government to remove him from the advisory board of Tamil Internet Education Corporation. Seshadri was removed from the board while an abusive, perverse and fraudulent character called Kannabiran Ravishankar was retained.

During this saga, Suba Veera Pandiyan while speaking at an event called names and threatened to cut off Seshadri’s janeu. Such speeches motivate the lower rung cadre to take violence in their own hands and someone threatening Brahmins for reciting Sanskrit slokas is one such outcome. Anti-Brahmin hatred and abuse is only strengthening day by day after DMK assumed power.

Mangaluru blast accused had met Coimbatore car blast accused in TN: Intelligence agencies

The central intelligence agencies probing the antecedents of the Mangaluru blast accused Mohammed Shariq and his connections in Tamil Nadu, have found that he had met the Coimbatore car blast accused Jamesha Mubeen in September.

Police found out that the duo had met at Siringanellur in Tamil Nadu.

Notably, Mohammed Shariq had stayed at a dormitory in Coimbatore and had secured a SIM card using the identity of his dormitory mate, Surendran, a private school teacher from Udhagamandalam. Surendran is in police custody.

The agencies are probing who all he had met and whether he received any help from Coimbatore and other areas of Tamil Nadu other than Surendran helping him procure a SIM card.

Investigations are also on to ascertain whether he had any role in the October 23 Deepavali eve car blast in Coimbatore in which Jamesha Mubeen was charred to death.

Six other accomplices of the deceased Mubeen were arrested under UAPA and lodged in Coimbatore central prison.

It may be noted that one of the arrested is Mohammed Talka who is the nephew of S.A. Basha, founder of Al Umma, the Islamic terror organisation involved in the Coimbatore serial blasts of 14 February 1998 in which 56 people died and more than 200 grievously injured.

The NIA and Central agencies have questioned a few people in certain pockets of the state to get more details on whether any support system had worked for Mohammed Shariq. After the ban of the Islamist organisation, Popular Front of India (PFI) in September 2022, some small organisations owing allegiance to Islamic ideology surfaced in some parts of Tamil Nadu, including Coimbatore.

The agencies are probing whether Mohammed Shariq had interacted with any of these six accused in the Coimbatore car blast case other than Jamesha Mubeen.

Tamil Nadu police have also taken into custody a few people in Chennai, Coimbatore, Tiruchi, and Madurai after the Mangaluru blasts and an investigation is on to see whether these people had provided any support to Mohammed Shariq.

A senior officer with Tamil Nadu police told IANS that those taken for questioning were involved in some nefarious activities earlier and had shown allegiance with some Islamic groups and movements including the banned PFI.

Md. Shariq hails from Shivamogga district in Karnataka and was living in a rented house in Mysuru using a stolen Hindu identity. He had also radicalized two young Muslim engineers to carry out trial explosions on the banks of Tungabhadra River in Hale Gurupura region of Shivamogga. He also had links with Mateen Ahmed Taha, who is said to be a member of ‘Al Hind ISIS’, which manages the terror outfit’s activities in Karnataka. 

Shariq had also visited Aluva in Kerala on several occasions and had reportedly procured raw materials to make an IED while staying there, including some electronics components ordered through Amazon.

In August, third-year engineering student Mir Anas Ali from Ambur, Tamil Nadu was arrested for planning a terror attack after contacting terror outfit IS (Islamic State). A few days before his arrest, three men were arrested for IS links from Erode and Salem.

In October, Hyderabad police arrested a person accused in past terrorist incidents and his two fresh recruits. They seized a consignment of 4 grenades from the Malakpet residence of Abdul Zahed, who reportedly revived his contacts with Pakistani ISI conduits to carry out sensational terror attacks in Hyderabad. Zahed and his recruits, Mohammad Sameeuddin and Maaz Hasan Farooq, were planning to target Hindu devotees during Ganesh Chaturthi festival celebrations.

The growing nexus of Islamic terrorists and radicals in Dakshin Bharat should worry every right-thinking citizens. The fact that most of these terrorists are bright, educated young men should bury the false notion of terrorism being caused by illiteracy and/or lack of economic opportunity, once and for all.

Central intelligence agencies like NIA are doing an exemplary job in busting these terror modules that are popping up all the time. But our judiciary seems to be marching to a different beat altogether, and is often giving bail or acquitting terror accused on dubious grounds, and some state governments driven by vote-bank politics are also diluting the collective response needed to combat this existential threat.

When will our Republic recognize the ideologies that are fundamentally opposed to our civilization and way of life?

Timber mafia from Meghalaya clashes with Assam’s forces – 6 killed, including 1 forest guard

A clash between Assam forest guards and the timber mafia operating in the Meghalaya-Assam border area turned deadly on the morning of November 22, leading to 6 deaths – 5 villagers from Meghalaya and 1 Assam forest guard. The incident reportedly happened at Mukroh village under Jirikinding PS, West Karbi Anglong district of Assam, an area bordering Meghalaya’s West Jaintia Hills district.

Assam’s West Karbi Anglong district’s Superintendent of Police Imdad Ali said that Forest Department officials intercepted a truck that was transporting illegal wood at around 3 a.m. on Tuesday morning

“When the forest guards approached the truck to seize the illegal consignment, it tried to flee. The guards opened fire and punctured the tyre of the vehicle. Three people, including the driver and his assistant , were apprehended, but others managed to flee from the scene,” he said.

The forest officials then informed the nearest police station at Jirikinding and requested for additional forces. According to the police, when a team reached there, a large number of people from Meghalaya surrounded them with sharp-edged weapons.

“The angry mob demanded the release of those arrested. The police team had to open fire to control the violent mob. A forest home guard and some members of the Khasi community were killed in the firing,” Ali said.

Video has emerged showing a large mob armed with sticks and other crude weapons surrounding the security personnel, who are forced to open fire in self-defence.

The dead forest guard has been identified as Bidya Singh Lehte while another forest guard, Abhimanyu, was injured in the incident. The 5 civilian deaths include – Thal Shadap, 45, Nikhasi Dhar, 65, and Sik Talang 55, died on the spot, while Tal Nartiang, 40 and Chirup Sumer, 40 succumbed to their injuries in the hospital.

Meghalaya blames Assam

However, Meghalaya Chief Minister Conrad K. Sangma blamed “unprovoked” firing by Assam Police and state forest guards for the incident. He claimed that Mukroh village falls in Meghalaya, stating “Assam Police and forest guards entered Mukroh village in West Jaintia Hills District and resorted to unprovoked firing, killing the five civilians of Meghalaya.”

Sangma said that the Meghalaya government would take ‘all kinds of steps’ to ensure action is taken against those responsible for this ‘inhuman act’. He also announced an ex-gratia compensation of Rs 5 lakh each to the next of kin of the deceased, and cancelled the iconic ‘cherry blossom’ festival in the state. The CM appealed to citizens of Meghalaya to maintain peace and harmony in the state.

Meghalaya police have lodged an FIR against Assam police and forest guards.

The Assam government has said that the firing incident at Mukhro village happened within the territory of Assam, and they have set up a one-man inquiry commission headed by a retired Judge of Gauhati high court to probe the incident.

If one looks at the Google map of the area, the village in question clearly falls on the Assam side. It is possible this area is part of the border dispute between Assam and Meghalaya, and hence both state’s are claiming it as their own.

Assam, which shares borders with six other Northeastern states — Nagaland (512.1 km), Arunachal Pradesh (804.1 km), Manipur (204.1 km), Mizoram (164.6 km), Tripura (46.3 km) and Meghalaya (884.9 km) — has boundary disputes at least with four Northeastern states — Nagaland, Arunachal Pradesh, Meghalaya, besides Mizoram.

As per reports, Assam CM Himanta Biswa Sarma is in constant touch with his Meghalaya counterpart over the incident which occurred at a time when both states were planning to hold the next round of discussion on border disputes shortly. On November 10, Sangma said the second round of discussions with Assam for resolving the border dispute was likely to start by the end of this month. Assam and Meghalaya identified 12 disputed areas at the inter-state border. In the first round, the two states resolved differences in six areas and signed an agreement in March.

Situation tense

In the wake of the incident, Meghalaya government has suspended mobile internet and data services for the next 48-hours from 10.30 a.m. on Tuesday in seven districts of the state – West Jaintia Hills, East Jaintia Hills, East Khasi Hills, Ri-Bhoi, Eastern West Khasi Hills, West Khasi Hills and South West Khasi Hills.

After the violent incident, several Assam vehicles were prevented from entering Meghalaya at Jorbat by police in a bid to prevent any untoward incident and public safety. Assam police have urged people from the state not to visit Meghalaya temporarily.

Such violence at inter-state borders is not uncommon in the North East. A major outbreak of violence along the Assam-Mizoram border on July 26, 2021 left 6 Assam Police personnel dead and nearly 100 civilians and security personnel of the two neighbouring states injured.

Many of the border areas that Assam shares with other states are beset with the problem of illegal Bangladeshi Muslim infiltration, and 3 of the states which it has a dispute with are Christian-majority states with a long history of discrimination and violence against non-Christian janjatis (tribals) and outsiders.

The problem is complex, and despite best efforts of all governments and the centre, violence seems to flare up from time to time.
