3 dead, 6 injured in latest US mass shooting, this time in Seattle

At least three people were killed and six others injured during a shooting at a hookah lounge in the US city of Seattle, police said.

Officers responded to reports of a shooting at Rainier Hookah Lounge just before 4.30 a.m. on Sunday, Xinhua news agency quoted the Seattle Police Department as saying.

Police found that two men and a woman had been shot, Seattle Police Chief Adrian Diaz said at a news conference on Sunday evening.

The two men, aged 22 and 32, died from injuries at the scene.

The woman, aged 30, was taken to hospital in critical condition. She died later in the day, Diaz added.

The injured were also taken to the hospital.

Four men and a woman were in stable condition as of Sunday evening.

A 23-year-old man was in critical condition, Seattle Fire Chief Harold Scoggins said at the news conference.

The Department’s homicide unit is leading an investigation. It’s not clear yet what led to the shooting or how many suspects have been involved.

Police confirmed they recovered at least five guns.

“It appeared they might have been trying to shut down the place, as well. But when it comes to the community, I believe it’s an isolated incident,” Diaz said.

Seattle Mayor Bruce Harrell said in a statement that even as Seattle police “keeps up a rapid and record pace of recovering guns — 869 through July — there are still more illegal guns in the wrong hands that could be used to incite another tragedy like this one”.

NCP’s Bhujbal asks “How many schools did Saraswati, Sharda Devi start”?

NCP (Nationalist Congress Party) neta Chhagan Bhujbal questioned whether Maa Saraswati had ‘constructed’ any schools while adding that Shahu-Phule-Ambedkar were his deities. He made the controversial remark during his speech at a school function organized by Maratha Vidya Prasarak Shikshan Samaj in Makhmalabad.

Mahatma Phule, Savitribai Phule, and Shahu Maharaj got the right to education for common people. Dr Babasaheb Ambedkar opened the doors of education to all by passing the Education Act. So they are my deity whereas some people worship the Saraswati or Sarada Devi. State Food and Civil Supplies Minister Chhagan Bhujbal asked how many schools Devi had ‘built’ and how many people She educated. He also said that he was not against any deity and those who want to worship them should do it, but he would worship only his ‘gods’.

Two hundred years ago, the education system was under the control of Brahmins. Women were also banned from learning. All the other sections of society were illiterate. So no one knew what their rights were. Who could they complain to? Mahatma Phule and Savitribai Phule opened the doors of education for the Bahujan community when there was a situation where complaints were received, and by Brahmins written and results were also given by Brahmins. Shahu Maharaj took the initiative and offered his everything to the cause. Bhujbal asserted that he is firm in his belief that photos of only such persons should be worshipped.

He is reported to have later clarified his stance saying he is also Hindu and I have erected several temples in Nashik. My statement has been deliberately politicized insisted Bhujbal. He further said that all he had said was it was wrong to conduct Devi’s puja by keeping the photos of the ‘mahapurushs’ away.

Not interested in vice presidency, says Vivek Ramaswamy: USA

 Indian-American entrepreneur Vivek Ramaswamy has said he is not interested in becoming the vice president if he doesn’t win the Republican presidential nomination in 2024.

In an interview to Fox News on Saturday, the youngest presidential candidate said that like his GOP rival Donald Trump, he would not do well in a number two position, ‘The Hill’ reported.

“I’m not interested in a different position in the government,” he said in a Fox News interview Saturday.

“Frankly, I’d drive change through the private sector sooner than becoming a number 2 or a number 3 in the federal government,” Ramaswamy said.

In the past, fellow Indian-American GOP presidential candidate Nikki Haley has also stated no interest in being the second-in-command. Ramaswamy, who is a political first-timer, pulled off a surprise on Saturday by tying with rival and Florida Governor Ron DeSantis in second place, according to a new poll.

The Emerson College poll showed DeSantis and Ramaswamy tied at 10 per cent each, behind former President Donald Trump, leading with 56 per cent. According to ‘The Hill’, almost half of Ramaswamy supporters said they will definitely vote for him, while only a third of DeSantis backers said the same.

Emerson College Polling Executive Director Spencer Kimball said in a statement that Ramaswamy has made improvements in voters with postgraduate degrees, taking 17 per cent of that group, and with younger voters, winning 16 per cent of those younger than 35.

Ramaswamy recently earned praise from billionaire entrepreneur Elon Musk who called him “a promising candidate”. Meanwhile, Ramaswamy and his rivals are actively preparing for the GOP’s first 2024 presidential debate on August 23. Republicans will meet in Milwaukee, Wisconsin, from July 15-18, 2024, for their national convention to formally select their party’s next presidential nominee.

Hypocritical double standards of United Nations Security Council

The United States is quick to condemn other nations for human rights violations but are mysteriously silent about their own.

The U.S. retains presidency of the UN this month and called for a meeting today regarding “the situation in the Democratic People’s Republic of Korea”. The US, a self-proclaimed “Christian nation” uses the UN as its mouthpiece to advance their own self-serving politicized agendas.

These Christians use the UN as their judge and jury. Today they accuse the DPRK of human rights violations, but they have also used this prybar against others, such as Sudan, Uganda, and Syria, to name a few.

And yet, UN workers themselves are found to be sex abusers and traffickers.

Kathryn Bolkovac, was a U.N. whistleblower who worked for the U.N.’s International Police Task Force in Bosnia. She discovered DynCorp, a defense contractor financed by the U.S. government was involved with a child sex trafficking ring, which was being covered up by the United Nations.

UN peacekeeping forces have also been accused of sexual assault and rape in Haiti.

These are incidents which have been brought to the light, and in the years since, UN peacekeepers have continued to be accused of sexual abuse the world over. Much like the Catholic priests, where there is one, you know there are many more. It seems to be a problem endemic to Christian culture.

Meanwhile, the Christian nation itself is guilty of human rights violations. Thousands are murdered, assaulted, raped, robbed and wrongfully detained. Verdicts and sentences are carried out without equity or due process. Criminals are set free, and victims are criminalized. Yet, our political preachers mingle at their prayer breakfasts, and stand in their pulpits, declaring one nation, under God, with liberty and justice for all. Like their book, on which they swear an oath, to tell the whole truth, and nothing but the truth, it is all a lie.

For example, in the case of George Floyd, an African American who was beaten and murdered in the middle of the street when a police officer kneeled on his neck as he cried out, I can’t breathe. Where was his justice? He was not a model citizen, but even criminals deserve basic human rights.

Unfortunately, Christians have never cared about justice. Their history proves this. And don’t get me wrong, this does not make me an apologist, neither do I feel anyone deserves reparations for past wrongs. The past is done, but what we do for the present and future, matters.

Furthermore, hundreds, if not thousands of African American men have befallen the same fate as George Floyd over the decades. If we go even further back, we see how the African American people have been oppressed for centuries. They have been groomed by white men, ensuring they are poverty stricken, uneducated and confined by the mental chains of colonialism.

Roman Catholic Jesuit missionaries captured Africans like animals, chained and packed them into slaver ships with no allowance for basic humanity or dignity, then delivered them to their masters.

“In fact, the Church was the backbone of the slave trade,” the authors wrote. “In other words, most of the slave traders and slave ship captains were very ‘good’ Christians.”

Huge numbers of people died being marched to the coasts of Africa from the interior as well as in an endless series of wars produced by the quest for new slaves. Millions more would die in concentration camps at both ends of the sea journey, and significant numbers would die due to the appalling conditions on the slave ships.“

When Malcolm X rose to leadership of the African American community in the 1960’s, he was trying to unite his people and raise them out from under Christian imperialist oppression.

Malcolm X saw Christianity as a religion for white men, finely tuned to ensure eternal subjugation of the black race. He said,

“The greatest miracle Christianity has achieved in America is that the Black man in white Christian hands has not grown violent. It is a miracle that twenty-two million Black people have not risen up against their oppressors in which they would have been justified by all moral criteria and even by the democratic traditions.” – Malcolm X

Indeed, that was the very fear the Christians had, that the African Americans would rise up and confront their oppressors, therefore, Malcolm X was assassinated for daring to fight for the rights of his people, their human rights.

To resist and to defy oppression, is OUR ultimate human right, regardless of race and religion. The world is again desperately waiting for leaders who will step forward and unify us in this just cause.

Years of mismanagement reduce Jadavpur Univ to suicide hotspot

Coming under the national scanner for all the wrong reasons seems to have become a regular affair for West Bengal. The latest is the mysterious death of a fresher student of Jadavpur University (JU), allegedly because of mental harassment and ragging by a group of senior students.

With arguments and counter- arguments flying thick over this tragedy, academic circles in the state feel that it is utter mismanagement on the part of the JU authorities to end the menace of ragging by adopting some simple applications following the example of several reputed universities and educational institutes at the national level who have brought down incidents of severe ragging to almost zero.

The first application point should be the students’ hostel of the university where the victim, who was yet to cross the age of 18, had to undergo such ragging. His body was found in front of the hostel on August 10.

The anti- ragging committee at the national level which was constituted under the chairmanship of former Central Bureau of Investigation director R.K. Raghavan had suggested a number of measures to prevent such incidents of ragging and harassment of junior students in the university campuses. As per the guidelines issued by the University Grants Commission (UGC) based on the recommendations of the Raghavan Committee, separate hostel accommodation for first- year students from that of senior students should be organised.

However, from the death of the fresher it is clear that this recommendation for a separate freshers’ hostel was completely ignored by the JU authorities. Now after the tragedy the JU authorities have taken some initiatives to separate the freshers’ hostel but it is too late for the victim who came to Kolkata from a remote village in Nadia district of West Bengal for higher education.

The UGC has already sent two notices to the JU authorities seeking clarifications on whether their anti- ragging guidelines were implemented by the university.

Another irregularity noticed at the students’ hostel is the illegal occupation of beds and rooms by former students even months after they had passed out. They also acted as the final word in accommodation-related affairs in the hostels.

The four former students of the university arrested by police in this connection have been accused by the hostel occupants as treating the hostel virtually as their parents property even months after passing out.

Another major violation by the JU authorities in implementing the anti- ragging guidelines was the reluctance to install CCTVs within the university campus.

The root of such mismanagement can be attributed to the fact that the JU has been operating for quite some time in a virtually headless state without a vice- chancellor. The chair of one of the two pro vice- chancellors is also vacant. The registrar of the university, Snehomonju Basu was on medical leave when the mishap took place on August 10 and she returned only on Monday, four days after the incident.

JU lost the chance of getting a permanent vice- chancellor because the recruitment was done without following the norms laid down by the University Grants Commission. After the retirement of the previous vice- chancellor Suranjan Das, things were managed for three months in an ad hoc manner by extending the term of Das but as an interim vice-chancellor.

Later Governor C.V Ananda Bose appointed the pro-vice-chancellor Amitava Dutta as the interim vice-chancellor. But Dutta resigned from the post arguably because of the tiff between the Governor’s House and the state education department over the Governor’s decision to appoint interim vice- chancellors for a number of state universities.

विस्थापन की त्रासदी

ऋषियों, मुनियों, मठों-मन्दिरों, विद्यापीठों और आध्यात्मिक केन्द्रों की भूमि कश्मीर ने एक-से-बढ़कर एक विद्वान उत्पन्न किए हैं। ये सब विद्वान पंडित कहलाए। ज्ञान रखने वाला और बाँटने वाला ‘पंडित’ कहलाता है। अतः ज्ञान की भूमि कश्मीर की जातीय पहचान ही ‘पंडित’ नाम से प्रसिद्ध हो गई। ‘कश्मीरी’ और ‘पंडित’ दोनों एकाकार होकर समानार्थी बन गए।कहना न होगा कि प्राचीन काल में कश्मीर में जिस भी धर्म,जाति,प्रजाति या संप्रदाय के लोग रहे होंगे, कालांतर में कश्मीरी हिन्दू अथवा पंडित ही धरती का स्वर्ग कहलाने वाले इस भूभाग के मूल निवासी कहलाये।

इस बीच गंगाजी और जेहलम में खूब पानी बहा। कश्मीर घाटी राजनीतिक संक्रमण और सामाजिक विघटन के भयावह दौर से कई बार गुज़री।अलग-अलग कालखंडों में इस्लामिक आतंकवाद अथवा जिहाद ने घाटी में रह रहे अल्पसंख्यक पंडितों/हिन्दुओं को बड़ी बेदर्दी से घाटी से खदेड़ा और उनके साथ तरह-तरह की ज्यादतियां कीं। बर्बरता का यह दौर हालांकि बहुत पहले से चला आ रहा था मगर परवान वह १९९० में चढ़ा।लगभग चार लाख पंडित जलावतन अथवा बेघर हुए और सैंकड़ों की संख्या में हत-आहत हुए।बलात्कार हुए,अग्निकांड हुए,लूट-मार हुयी,चल-अचल संपत्तियां हथियायी गयीं आदि-आदि।

दरअसल, १९४७ में जब देश आजाद हुआ तो जम्मू-कश्मीर के अधिकार को लेकर भारत और पकिस्तान में विवाद छिड़ गया। पाकिस्तान ने जम्मू कश्मीर को अपने अधिकार में करने की बहुत कोशिश की। लेकिन जब वह असफल रहा तो उसने घाटी पर कबाइली आक्रमण कराया और कई आतंकवादी संगठन भारत में तैयार करने लगा, जिसका बुरा प्रभाव जम्मू-कश्मीर के लोगों पर पड़ने लगा।इतिहास गवाह है कि कश्मीर में मुसलमानों का शासन आरम्भ होने के बाद वहाँ मुसलमानों की आबादी तेजी से बढ़ने लगी। परिणामस्वरूप कश्मीर को भारतीय सभ्यता, संस्कृति एवं इतिहास की अन्तर्धारा से विमुख कर उसे इस्लामी संस्कृति से जोड़ने की कोशिशें विगत पाँच सदियों से होती रही हैं।

अलगाववादी विद्रोह और इस्लामिक जिहाद के कारण 1989 में कश्मीर घाटी से पंडितों के व्यापक विस्थापन की जो पृष्ठभूमि बनी, उसके लिये कश्मीरी पंडित बिरादरी के टीका लाल तपलू, नींलकंठ गंजू, सर्वानन्द कौल ‘प्रेमी’, बालकृष्ण गंजू,गिरिजा टिक्कू आदि की जिहादियों द्वारा की गयी निर्मम हत्याएं विशेष रूप से ज़िम्मेदार रही हैं। हालांकि 1990 के आसपास और बाद के वर्षों में और भी अनेक पंडित जिहादियों की बंदूक का निशाना बने, मगर उपर्युक्त पंडितों के बलिदान ने कश्मीरी पंडितों के विस्थापन की त्रासदी को  इतिहास बना दिया।

मोटे तौर पर कश्मीर घाटी से पंडितों के विस्थापन की त्रासदी की शुरुआत यहीं से होती है।इस त्रासदी का एक पक्ष और भी है। शांतिप्रिय पंडितों के विस्थापन की त्रासदी को हर स्तर पर भुनाया तो गया मगर समाधान कोई सामने नहीं आया।जिनको इस त्रासदी से फायदा उठाना था वे फायदा उठा गए,अब फट्टे में पैर कोई क्योंकर देने लगा?पंडित उग्रवादी या अतिवादी भी हो नहीं सकता क्योंकि धर्मपरायणता,सुशिक्षा और अच्छे संस्कार ही उसकी पूंजी है जो उसे अनुशासनप्रिय और शांतिप्रिय बनाती है।मगर सच्चाई यह भी है कि आज के दौर में ‘दुर्जन’की वंदना पहले और ‘सज्जन’की बाद में होती है।और फिर कश्मीरी पंडित कोई वोट-बैंक भी तो नहीं है।

प्रस्तुत पुस्तक में कश्मीरी पंडितों की घाटी से विस्थापन की व्यथा-कथा को कतिपय निबंधों के माध्यम से लिपिबद्ध करने का प्रयास किया गया है।ये सारगर्भित निबंध देश की विभिन्न पत्र-पत्रिकाओं में समय-समय पर प्रकाशित हुए हैं और खूब सराहे गये हैं।

आशा है सुधी पाठकों को पुस्तक में संकलित निबन्धों से कश्मीर में हुयी ‘विस्थापन की त्रासदी’ को निकट से समझने का अवसर मिल जाएगा।पुस्तक शीघ्र अमेजन और फ्लिपकार्ट पर उपलब्ध होगी।

Gandhi statue vandalised in K’taka village

Unidentified miscreants have vandalised a Mahatma Gandhi statue in a village in Karnataka’s Shivamogga district, police said on Monday.

The incident occurred in the Holehonnuru village and the police believe that the vandalisation must have taken place on Sunday night,

The statue was installed in the main junction of the village 18 years ago.

As part of its ongoing probe into the incident, the police have already started recording statements.

As of now, there has been no arrests.

Additional details are awaited.

कांग्रेस की “अनपढ़” धरोहर विजयलक्ष्मी पंडित

कहानी नेहरू की “अनपढ़” बहन की… जिसे नेहरू ने सोवियत संघ, अमेरिका और ब्रिटेन में भारत का राजदूत / हाई कमिश्नर बनाया। वो “अनपढ़” बहन जिसने कॉलेज तो छोड़िये, स्कूल का भी मुंह नहीं देखा था, फिर भी उसे यूपी में मंत्री बनाया, महाराष्ट्र का राज्यपाल बनाया और सांसद भी बनाया।

इस “अनपढ़” बहन को 8 करोड़ लाशों पर खड़ा चीन का तानाशाह माओ-त्से-तुंग अहिंसा के पुजारी गांधी की तरह लगता था। वो “अनपढ़” बहन जिसने भारत को सुरक्षा परिषद की स्थायी सीट मिलने में अडंगा डाला। कांग्रेस के धूर्त और मक्कार इतिहासकारों ने आज विजयलक्ष्मी पंडित पर बहुत लिखा, लेकिन असली बातें छुपा लीं।

ये कहानी ज़रा लंबी है, लेकिन सुनना बहुत ज़रूरी है। वो इसलिए क्योंकि जब इस देश में अनपढ़ नेताओं, नेताओं की फर्जी डिग्री और न जाने क्या-क्या चर्चा चल रही है तो आपको पता होना चाहिए कि परिवारवाद का वो काला सच जिसमें एक अनपढ़ इंसान सारी ऊंचाइयां पा लेता है, क्योंकि उसका जन्म आनंद भवन में हुआ था।

जवाहरलाल नेहरू की छोटी बहन विजयलक्ष्मी पंडित का जन्म आज ही के दिन 18 अगस्त 1900 को आनंद भवन में हुआ था। वो बचपन में कभी स्कूल नहीं गईं तो फिर कॉलेज कैसे जातीं??? घर में रहने वाली एक अंग्रेज़ आया (केयर टेकर) जेन हूपर ने इन्हें अक्षर ज्ञान और थोड़ी बहुत शिक्षा दे दी। लेकिन जब आप नेहरू खानदान के चश्मों चिराग हो तो फिर किसी डिग्री की क्या ज़रूरत है? अब इनका करियर ग्राफ और इनके कारनामे देखिये – यूपी (तब यूनाइटेड प्रोविंस) की स्वास्थ्य मंत्री 1937 के चुनावों में ये विधायक चुनी गईं और कांग्रेस की सरकार में स्वास्थ्य मंत्री बनीं।

आप लोग नाहक ही तेजू भैया (तेज प्रताप यादव) पर सवाल उठाते हैं। जब विजय लक्ष्मी पंडित यूपी की स्वास्थ्य मंत्री बन सकती हैं, तो हमारे तेजू भैया बिहार के स्वास्थ्य की देखभाल क्यों नहीं कर सकते??? सोवियत संघ (वर्तमान रूस) में भारत की प्रथम राजदूत विदेश नीति से नेहरू-गांधी परिवार का पुराना नाता है। नेहरू से लेकर राहुल-प्रियंका तक, सब खुद को विदेश नीति का एक्सपर्ट समझते हैं। कई बार तो ऐसा लगता है कि नेहरू-गांधी परिवार के बच्चे स्कूल में एडमिशन नहीं लेते, बल्कि वो सीधे यूनाइटेड नेशन्स में पढ़ने चले जाते हैं, जहां वो A फॉर America, B फॉर Britain और C फॉर China सीखते हैं। नेहरू की बहन विजय लक्ष्मी पंडित भी ऐसी ही हाईली टैलेंटेड थीं

1947 में जब भारत आज़ाद हुआ तो नेहरू ने अपनी बहन विजय लक्ष्मी पंडित को भारत का राजदूत बना कर भेज दिया। ये 1949 तक इस पद पर रहीं और बेहद नाकाम साबित हुईं। तानाशाह स्टालिन पूरे दो साल तक नेहरू की इस अनपढ़ बहन से नहीं मिला। भारत और सोवियत संघ के संबंधों का ये सबसे ठंडा दौर था। मास्को में रहने के दौरान इनकी वजह से भारत को काफी बदनामी झेलनी पड़ी। आरोप है कि इन्होंने अपने सरकारी घर के लिये मास्को के बजाय स्वीडन के स्टॉकहोम से महंगा फर्नीचर खरीदा। जिस पर सोवियत संघ सरकार ने आपत्ति जताई।

गांधी ने भी विजय लक्ष्मी पंडित की इस फिजूलखर्ची पर आलोचना की थी, इस पर नेहरू को सफाई देनी पड़ी। अमेरिका में भारत की राजदूत जब विजय लक्ष्मी पंडित की दाल स्टालिन के सामने नहीं गली तो इन्हें इनके जवाहर भैया ने 1949 में वाशिंगटन में भारत का राजदूत बना कर भेज दिया। यहां भी इन्होंने बंटाधार करने में कोई कसर नहीं छोड़ी। अमेरिका और ब्रिटेन चाहते थे कि संयुक्त राष्ट्र की सुरक्षा परिषद में चीन की बजाय भारत को स्थायी सीट दी जाये।

इस प्रस्ताव की जानकारी जब विजयलक्ष्मी को मिली तो उन्होंने अपने भाई प्रधानमंत्री नेहरु को 24 अगस्त 1949 को एक पत्र और बताया कि – अमेरिकी विदेश मंत्रालय में भारत को सुरक्षा परिषद में स्थायी सीट मिलने की चर्चा चल रही और भारत के पक्ष में माहौल बनाया जा रहा है। लेकिन मैंने सलाह दी है कि इस मामले में धीमे चलें क्योंकि भारत इसे पसंद नहीं करेगा।

वाह… 8 करोड़ इंसानी लाशों पर खड़ा चीन का ये शैतान तानाशाह माओ-त्से-तुंग इस अनपढ़ बहन को गांधी की तरह दिख रहा था। अब देखिए नेहरू की ये लाडली बहन चीन के एक और नेता चाउ एन लाई के लिए क्या लिखती है… विजय लक्ष्मी का ये पत्र भी कॉमरेड रामचंद्र गुहा ने अपनी पुस्तक में छापा है, अनपढ़ बहन लिखती है – “चाउ एन लाई लोगों को हंसने पर मजबूर कर देते हैं और खुद भी अक्सर हंसते रहते हैं। हम लोगों ने बेहतरीन शराब पी और स्वादिष्ट खाना खाया। फिर दोनों देशों के बीच मित्रता, संस्कृति और शांति की बातें हुईं। ये बातें तब तक होती रहीं जब तक कि हम थककर चूर नहीं हो गये।

वो आगे लिखती हैं कि मास्को की तरह यहां लोगों पर अत्याचार नहीं किया जा रहा और चीन में हर आदमी खुश लगता है।” चीन में आठ करोड़ लोग मार दिये गये और इस अनपढ़ महिला को सब खुश दिख रहे थे। नेहरू ने विजयलक्ष्मी पंडित की सलाह पर अमल किया और चीन से दोस्ती की राह पर आगे चल निकले और बाद में इसी माओ और चाऊ की जोड़ ने 1962 में भारत की पीठ पर खंजर भोंक दिया।

Bharat moves a step closer to collar 26/ 11 accused Tahawwur Rana after ruling by US court

In what brings 26/11 terror attack accused Pakistani-origin Canadian businessman Tahawwur Rana closer to extradition to Bharat, a US court has denied the writ of habeas corpus filed by him.

The denial has paved the way for US Secretary of State Antony Blinken to issue a certification for him to be extradited to Bharat where he is facing a trial for his alleged involvement in the 2008 Mumbai terror attacks.

“The court has denied Tahawwur Rana’s petition for writ of habeas corpus by a separate order,” read orders by Judge Dale S Fischer, United States District Judge, Central District of California.

During the recently concluded monsoon session of the Bharatiya parliament the Home Minister Amit Shah had informed the House that Tahawwur Rana would face the Bharatiya judiciary soon.

Rana has filed an appeal against the order and sought a stay on his extradition to Bharat till the time his appeal in the Ninth Circuit Court is heard. He had filed “writ of habeas corpus” in June this year challenging a court order that acceded to the request of the US government that the 2008 Mumbai terror attacks accused be extradited to Bharat.

The special public prosecutor of the 26/11 case Ujjwal Nikam said that it was a great diplomatic success and a major blow to terrorism. “With extradition almost finalised, we now need to decide which court he will be tried, whether in the NIA court at Delhi or elsewhere, those questions will be decided by the investigating agency,” Said Nikam.

Judge Fischer in his rejection order said that he didn’t find any solid grounds as Rana has only made two basic arguments in the writ. First, he claims that, pursuant to the treaty, he cannot be extradited because Bharat plans to prosecute him for the same acts for which he was charged and acquitted in a United States court. Second, he argues that the government has not established that there is probable cause to believe that Rana committed the Indian offenses for which he is expected to stand trial, the judge said.

“Given that, even if (David) Headley’s testimony were the entire basis for the probable cause finding, it would be sufficient for the purposes of habeas review because it constitutes some competent evidence supporting the finding. For the reasons stated above, Rana’s petition for a writ of habeas corpus is DENIED,” the judge wrote.

Tahawwur Rana was arrested in the US on an extradition request by Bharat for his role in the Mumbai attacks that killed 175 people, including six Americans.

Bharatiya authorities allege that Rana conspired with his childhood friend David Coleman Headley to assist the Pakistani terror group Lashkar-e-Taiba in orchestrating the terror attacks. David Headley had pleaded guilty and testified against Rana.

Following Judge Fischer’s order, Patrick Blegen and John D Cline, Rana’s two attorneys filed an appeal to the United States Court of Appeals for the Ninth Circuit from the Order entered on August 10, 2023, for denying his petition for writ of habeas corpus.

In a separate appeal, Blegen has filed a petition “for a stay of extradition pending his appeal” to the United States Court of Appeals for the Ninth Circuit from the court’s order denying his petition for a writ of habeas corpus.

“As set forth in the accompanying memorandum, petitioner submits that a stay of extradition pending appeal is appropriate because he has made a strong showing that he is likely to succeed on the merits of his non bis in idem claim; he will suffer irreparable harm if he is extradited, potentially including the death penalty; a stay pending appeal will not substantially injure the government; and the public interest favors a full review of Rana’s non bis claim before he is sent to a country that seeks to execute him,” Rana’s attorney wrote on August 14.

In June, the Biden administration had urged the court to deny the writ of habeas corpus filed by Rana. “The United States respectfully requests that the court deny Rana’s petition for a writ of habeas corpus,” said E Martin Estrada, US attorney for Central District of California, in his petition filed before the US District Court for the Central District of California.

Why Secularism is dangerous – Part 2: French “Laïcité” as a source of major injustice

France is founded on the principle of separation between state and society on one hand, and any church or religious institution on the other, as established by the December 9, 1905, law, passed during the Third French Republic (September 1870–July 1940). Although differently interpreted, for some this is the major legal rationale behind the French state’s strong and constant anti-religious push, which floods also on civic society, serving as the basis of all possible subsequent national and local legislation in this field (with the exceptions of the region known as “Alsace-Moselle” as well as some French overseas departments and semi-autonomous collectivities.) Since 2011, France even celebrates that separation with a national annual day of observance on December 9.

On August 24, 2021, the French National Assembly approved the so-called law against separatism, aimed at forbidding any religious community to organize itself as a separate entity from the French society. It did it in the name of national unity. In reality, this served as a new major anti-religious measure, interposing new serious obstacles between religious groups and the fundamental human right of their members to enjoy religious liberty. All initiatives and institutions, like schools and others, which are inspired or promoted by organizations of believers, religious groups and churches, can in fact easily fall under the sickle of that legislation.

It is moreover worth noting that the new French law culturally creates the “crime” of “separatism,” which amounts almost to a blasphemy for the philosophical and political concept of the modern unitary and intangible nation-state. This remotely originates in the principle “Cuius regio, eius religio,” or “whose realm, their religion.” It means that the faith, or culture, or by extension any will of a ruler, that rulers have the force and means to implement in their countries, dictate those of the ruled, with little or no space for exceptions.

Defining the feature of the modern nation-state, that principle was first uttered at the Peace of Augsburg (a city in Germany), a treaty signed on September 25, 1555, between the Holy Roman Emperor Charles V (1500–1558) and the Schmalkaldic League (an alliance of Protestant principalities and cities within the Empire) that put an end to a serious religious war. It was then confirmed by the Peace of Westphalia (a region in Germany), as the multiple treaties signed on October 24, 1648, are known, ending the Thirty Years’ War (1618–1648), a bloody European conflict with a religious component.

Growing over centuries more and more secularized, and less and less democratic, the “whose realm, their religion” concept crafted the idea of the modern state step by step. Increasingly, it came to mean the recognition of no authority above and no loyalty below the ruler. In this fashion, it characterized the most bigoted period of the so-called Ancién Regime (whatever reality and span of time that expression really indicates) and the most despotic spirit of monarchical absolutism (although absolutism had shades and graduations). Then, the philosophy of the Enlightenment transformed its accidents but not its substance, as Alexis Charles Henri Clérel, comte de Tocqueville (1805–1859) acutely noted in his 1856 essay “L’Ancien Régime et la Révolution,” so that the identity of the modern state could triumph with the French Revolution (1789–1799). From believing to be anointed by God (and perhaps needing no church), the modern rulers ended up considering themselves to be God-like. Finally, when the French Revolution organized the anti-religious religion of secularism through the new word/concept “ideology,” the modern state became the ultimate ruler. Its power was larger than ever, and it needed no God.

As to the original concept “whose realm, their religion,” once religion was eliminated, its most updated version came to be the idea “one nation, one state.” This philosophy is not officialized in any document, but it pervades the understanding that many modern countries have of themselves. Here the “nation” is what the state decides it to be—basically, one human group defined by ethnicity, or by adherence to state ideology.

The word “nation” deserves attention. It comes from the Latin noun “natio,” meaning “birth.” It indicates the community of people having a communality of birth, and possibly of destiny and historic role. It is often meant only in a geographical sense, as the physical place where a community originates and/or lives, but its meaning is larger and deeper. The communality of birth is in fact chiefly a cultural concept. So, a “natio,” a “nation,” is the communal tract of people born within a culture and sharing it. The defense of this cultural identity is called patriotism, and it may or may not take the historical shape of the defense of some historic geographical borders. Nonetheless, a nation is not the same as a state (which in turn is not the same as a government), and when the defense of a cultural identity degrades to the chauvinistic sense of supremacy of an ethnic group on others, the first being perceived as the only standard-bearer of a national culture, nationalism as a fanatic and intolerant caricature of patriotism comes in, and possibly racism as well. What then should always be checked is to what extent a nation-state tends to become nationalistic.

In a rigid nation-state, in fact, linguistic, cultural, and even ethnic minorities tend to have, or concretely have, difficulties, also within a democratic context, depending on the maturity, the quality, and the level of the democracy practiced by the government. At this point, one can’t do without noting that the paroxysmal exacerbation of that idea was a core principle of the Nazi creed, epitomized in the sentence “Ein Volk, ein Reich, ein Führer,” or “One people, one state, one leader.”

An iconic image of the German and “Aryan” nationalistic extremism was a 1935‒1936 painting endorsing Adolf Hitler (1889–1945) by German artist Heinrich Knirr (1862–1944), who used a 1935 photograph by Hitler’s personal photographer, Heinrich Hoffman (1885–1957). Hitler personally approved Knirr’s painting, which was later widely used as propaganda, most probably from around 1940. It is now displayed in a poster-format reproduction at the United States Holocaust Memorial Museum, in Washington, D.C. Of course, it would be silly to claim a similarity between modern nation-states and Nazi Germany, or today France and the Third Reich, but curiously “separatism” is the same word used by both the new French law curtailing religious liberty and the neo-post-national-communist regime governing today’s China to violently repress religious and ethnic groups through false accusations of terrorism.

As it is revealed by the emblematic case of Nice, France, reported in the first article of this series, the first and paradigmatic application of France’s radical attitude toward religions takes place in public schools. In fact, all nation-states and nationalisms, even in their democratic incarnations, consider schools the molding factories where loyal citizens should be produced, while believers tend to be regarded with suspicion (and in the worst cases discriminated) for their supposed double loyalty—not only to the state but also to their religion.

In France, the official state doctrine to be implemented since the first school years is known as “laïcité” and the word’s meaning is subtler than some may believe. The word derives from the Latin “laicus,” both adjective (with its gender declination) and noun, which in the Middle Ages indicated a non-cleric Catholic believer. In English, “laicus” was translated with two different words: the adjective “lay” and the noun “layperson.” From “non-cleric,” the word passed slowly to indicate also an unchurched person, then subtly “only” an unchurched man or woman, and finally the exact contrary of a believer: an agnostic by conviction or method, and even an atheist.

A curious appendix: in the English language, the noun “clerk,” indicating a lay employee who works with records, accounts, letters, etc., derives from “cleric” (in Latin “clericus,”) or clergyman. In fact, during the Middle Ages and early modern times, the educated people who could perform the duties of a modern lay clerk where clergymen. But even more curiously, in the Church of England the layperson that assists in the church services is called “parish clerk.”

Yet the original value of “lay” as a non-ecclesiastical person remained, sometimes drowned by the new meanings of the word, sometimes struggling but able to surface. A parallel fate had the English word “secular,” French “séculier.” Deriving from Latin “sæculum,” more or less synonym of “mundum,” “world” in English and “monde” in French, in the Middle Ages it indicated those who lived “in the world” as opposed to those who lived separated from it, i.e. in monasteries and convents, or in complete solitude as hermits. Per se, a secular person was simply—again—somebody who was not a cleric, thus a layperson. Only those extreme currents in Christian thought (not all of them orthodox) that dialectically opposed ecclesiastical life to lay life came to regard “mundus” as a place of moral depravity, starting to call “mundane,” in a pejorative and derogatory sense, all those persons and things that were not connected with the church.

Thus, from being substantially similar to “lay,” the adjective “secular” became a synonym of “irreligious,” and from this it went to “unchurched” and finally to “opposed to faith.” Yet again this happened to the English and French word “profane,” which comes from the Mediaeval Latin “profanus” composed by “fanum,” “temple,” and “pro,” as “in front of” and “before,” to mean “what is outside a sacred area.” Following the same semantical degradation, it ended to mean “vulgar,” “offensive,” or even “blasphemous.”

Truly, to save the etymological origin of these words, while accounting for their history, some modern scholars distinguish between “laicism” and “secularism” on one hand, and “laicity” and “secularity” on the other. But in English—the “lingua franca” of today’s world as Latin was in older times— “laicity” and “secularity” are not commonly used, and thus “secular” and “secularism” cover a full range of different meanings. Sometimes, one meaning and its opposite.

Exploiting ambiguities and loopholes inside the words “lay,” “secular,” and even “profane,” often used lightheartedly, France uses “laicity” to mean “laicism” and “secularity” to mean “secularism,” all compressed within the concept of “laïcité.” So, there may be people defending “laïcité” in good faith, meaning “laicity,” and double-tongued demagogues who use “laïcité” to impose “laicism.”

But of course it is not only a French problem. In the Babel of tongues responsible for counterfeiting the real meaning of words, it is normal to see people advocating secularism to promote irreligion, or even the persecution of believers, as well as people invoking secularism for the opposite reason: defending religious groups and individuals in confessional states where they are minorities, threatened or persecuted. For example, this happens—of all places—in Bangladesh, a story to be told in the third article of this series.
