“Referring to a quote from Russian author Fyodor Dostoyevsky’s book “Crime and Punishment,” the Delhi High Court on Monday (20th May) altered and decreased the sentence granted to five members of the terror organisation Jaish-e-Mohammed (JeM). The court reduced the punishment from life imprisonment to ten years of prison time for the offense under Section 121A of the Indian Penal Code.

A division bench consisting of Justice Suresh Kumar Kait and Justice Manoj Jain disposed the appeals filed by Bilal Ahmad Mir, Sajjad Ahmad Khan, Muzaffar Ahmad Bhat, Mehraj-ud-Din Chopan, and Ishfaq Ahmad Bhatt challenging the trial court’s ruling providing them sentences of life imprisonment.

The bench additionally reduced the sentence from life imprisonment to rigorous imprisonment for ten years for violating Section 23 of the UAPA. “The man who has a conscience suffers whilst acknowledging his sin. We refer to a quote by Fyodor Dostoyevsky, the author of “Crime and Punishment” and in chapter 19, Dostoevsky writes that “if he has a conscience he will suffer for his mistake; that will be punishment- as well as the prison,” the court said……”

“उत्तर प्रदेश के बरेली जिले में कॉलेज की एक हिन्दू छात्रा को इस्लाम कबूल कर के निकाह करने की धमकी दी जा रही है। धमकी देने वाले आरोपितों के नाम फ़ैज़ाल और आमीन बताए जा रहे हैं। पीड़िता को उसके व्हाट्सएप नंबर पर ब्लू फ़िल्में भेजी गईं। इसी के साथ AI टूल की मदद से छात्रा का अश्लील वीडियो बनाने की बात भी कही गई है। पुलिस ने सोमवार (20 मई, 2024) को FIR दर्ज कर के जाँच शुरू कर दी है।

यह मामला बरेली के थाना क्षेत्र भोजीपुरा का है। यहाँ सोमवार को पीड़िता के पिता ने पुलिस में शिकायत दर्ज करवाई है। शिकायत में उन्होंने बताया कि उनकी बेटी पास के ही एक कॉलेज में पढ़ने जाती है। मंगलवार (7 मई, 2024) को पीड़िता के व्हाट्सएप पर एक अनजान नंबर से Hi लिख कर आया। छात्र ने इसका कोई जवाब नहीं दिया तो सामने वाले ने कॉल किया और जबदस्ती बात करने की कोशिश की। कॉल के दौरान कॉलर ने कहा, “तू मुझे अच्छी लगती है। धर्म परिवर्तन कर के इस्लाम अपना ले। मैं तुझे हमेशा खुश रखूँगा।”

इतना सुन कर पीड़िता ने फोन काट दिया। 19 मई को एक बार फिर से उसी नंबर से पीड़िता को मैसेज आया। जब लड़की ने परिचय पूछा तो कॉलर वीडियो कॉल करने लगा। फोन न उठाने पर उसने पीड़िता को ब्लू फ़िल्में और अश्लील मैसेज भेजने शुरू कर दिए। लड़की ने ऐसे मैसेज न भेजने की गुजारिश की तो उसे गंदी-गंदी गालियों के साथ घर से उठा ले जाने की धमकी दी गई। कॉलर ने यह भी कहा कि अगर उसने किसी को बताया तो पीड़िता को जान से मार दिया जाएगा…..”

“In Kerala’s Kollam, a local Youth Congress leader named Ashiq Badaruddin has been arrested for capturing videos of women with a camera placed in a toilet. As per reports, Ashiq Badaruddin, a local Youth Congress leader working as a toilet operator in Thenmala was arrested after women complained of his attempts to capture videos.

Accused Ashiq Badaruddin is the general secretary of Youth Congress in Punalur block. After the complaint by the women, Badaruddin was arrested and produced in court by police. Police have seized his mobile phone.

As per reports, Ashiq (30), works as a toilet operator in Thenmala Dam. He allegedly placed a camera inside the women’s washroom. On May 21, some girls women who were visiting from Thiruvananthapuram noticed the camera and complained against Ashiq Badaruddin to the police……”

“On 20th May, a video of a man beating his wife went viral on the social media platform X. It was revealed that the man in the video was identified as Aquib Mir from Bathandi, Jammu. Upon investigating the case, OpIndia found that Aquib had posed as a Hindu boy to lure the woman he was beating in the video into a relationship.

OpIndia accessed the FIR registered against Aquib under Sections 376, 420, 400, 504, 506, and 34 of the Indian Penal Code IPC and talked to the victim for details. As per the FIR, the victim was already married and had a son when she came in contact with Aquib. In her complaint, she said that at that time, she was in a vulnerable position as her husband was suffering from medical issues leading to stress and an emotionally weak situation.

Speaking to OpIndia, the victim revealed that her husband was an alcoholic and she had been separated from him. Aquib contacted her on Instagram posing as a Hindu man named Ravi Rajput in 2021. They became friends and slowly came closer…..”

Book review of Integration of Bharat: Political and Constitutional Perspective

Certain terms and expressions that often become the subject of discussion, be it in academia, media, society, etc., lose their significance if they are not presented and understood with their proper background. Therefore, an appropriate perspective is necessary in any academic writing or historical account. One such recent instance is the debate about the term Bharat and its significance.

Article 1 of the constitution of Bharat uses the term “India, that is Bharat” while defining the nature of the union of Bharat. The importance and significance of this term can only be understood if they are read and seen in the light of Constituent Assembly debates pertaining to article 1, wherein it was elaborately narrated as to why the nomenclature of Bharat will remain incomplete unless the term ‘Bharat’ is used along with ‘India’. Scholars in the Constituent Assembly demonstrated with their vast knowledge that the term Bharat not only stands for a nomenclature but also signifies the perennial journey of our great nation that has been continuing for the past thousands of years.

The story of ‘Integration of Bharat: Political and Constitutional Perspective’ is one such literary work authored by Yashraj Singh Bundela’ who happens to be a constitutional lawyer and a devout history lover and has connected a vast arena of Bharat’s journey of thousands of years from a cultural national entity to a present constitutional republic. To understand any legal or constitutional issue, it is very important to know its historical background. Therefore, history and law always go hand in hand.

One who knows the value of history and culture can never become detached from it. Yashraj Singh Bundela, an Advocate on Record at the Hon’ble Supreme Court, is one such prominent person. In this artwork, the author clearly pictured in one of the very first chapters how the term Bharat emerged from the slokas of Vishnu Purana.

As a practising advocate, I always believe that the law as a subject is vast, and it is undoubtedly a fact that history and political science are identical twins of every law that our law-making bodies frame following a constitutional procedure. The book beautifully narrates as to how the various aspects of the state and the institutions governing it evolved over the years as demonstrated by Atharva Veda, Kautilya’s Arthashastra, etc.

This book deserves appreciation for explaining all the cultural, political and constitutional history behind the formation of states and provinces in Bharat and their gradual integration within the framework of the Constitution of India. The author has also made a valiant effort by not only narrating the story and journey of integration with the help of historical facts, political narratives and legal provisions but also using various case laws and judgements of the Hon’ble Supreme Court in very elucidating and precise manner.

This book has emphasised on several other cases where the Supreme Court had narrated the vast journey of our constitutional integration, for instance in cases like H. Maharajadhiraja Madhav Rao Jivaji Rao Scindia and others v Union of India where it was held that the presidential orders, taking away the recognition of the rulers of the erstwhile princely states as unconstitutional, Raghunathrao Ganapath Rao v Union of India, where the Hon’ble Supreme court upheld the 26th Constitutional Amendment Act of 1971 denying the contentions of the petitioner that the said amendment is changing personality, identity, character or basic structure etc.

This part of the book where the author has cited and explained several cases in explaining the functioning and inter-relationship between various law-making bodies and other necessary political institutions that played a significant role in the emergence and working of robust constitutional structure for the administration of vast area of territories including, States, Union Territories etc., deserves special attention from the legal and the political science scholars.

Generally, in the history that is taught in primary educational institutes, the glorious chapters that encompasses the significant roles played by the Bharatiya rulers in protecting the frontiers, territories and culture of Bharat for the past thousands of years against the foreign invaders have been eclipsed. Interestingly the author in the book has eminently demonstrated the significant roles played by various rulers from every possible region of Bharat raging from the north to south and east to west.

For example, the contributions made by Bharatiya rulers like Malvas, Marathas, Bundelas, Dashamgurus, Mewars, Vijayanagaras, Chozhas (aka cholas), Pandiyas, Pallavas, Chalukyas, Ahoms, Shahis, Kharvelas, Rashtrakootas, Gurjar-Pratiharas, Palas, Nagas, etc have hardly come into light. One such assurance that every citizen who aspires to be a scholar or a public servant gets from pursuing this book is that he gets to cover the history of all the unsung warriors in one go.

This book also narrates that after suffering all the wraths in resisting foreign invasions of Greek, Sakhas, Kushans, Huns, Turks, Mughals, Europeans including French Portuguese, Dutch, English, etc. this nation emerged as an independent, sovereign and constitutionally governed country. The book also narrates the integration of territories such as Goa, Pondicherry and Sikkim including reorganisation of the States.

In this history of integration of Bharat, the author has elaborately dealt with the integration of Jammu and Kashmir in vast detail covering its history, subjugation suffering from human right violations at the hands of separatists and the foreign power who were actively involved in separation and political destabilisation in the State of Jammu and Kashmir. The author makes a strong case that the history of accession and constitutional integration of Jammu and Kashmir cannot be understood in isolation as it is understood with that of other princely states.

The entire process of integration demonstrates that unlike Egypt, Persia, Rome, Greece, Bharat and its cultural roots remained the same no matter how hard the invaders tried to destroy it. It clearly teaches that the culture is the identity of every nation and once that identity is lost it is nothing but a direct collapse of an edifice on which a nation stands.

The book is a tribute to the great work of revered Ironman of Bharat, Shri Sardar Vallabhbhai Patel, who served his best to shape the territorial structure of Bharat. The book in detail narrates the story of accessions of States like Travancore, Kochi, Mysore, Hyderabad, Junagarh, Bhopal, Jodhpur, Manipur, Tripura, etc. The author has taken up a very good initiative to narrate the unsung constitutional history of Bharat. It is submitted that this book is a crucial source to understand the present constitutional framework of Bharatiya politics in its appropriate historical context.

Bharat Sevashram monk moves Calcutta HC seeking protection against possible attack on Ashram

Kolkata, May 21 (IANS) Kartik Maharaj, a monk associated with the Bharat Sevashram Sangha’s Beldanga unit in Murshidabad district, approached the Calcutta High Court on Tuesday seeking protection against a possible attack on the Ashram.

On Monday, Kartik Maharaj sent a legal notice to Chief Minister Mamata Banerjee after she accused him at a public meeting of working on BJP’s behalf to influence the voters to vote in favour of the Bharatiya Janata Party.

On Tuesday, Kartik Maharaj claimed before mediapersons that he received a threat call on Monday wherein the caller threatened to demolish the Bharat Sevashram Sangha’s entire setup in Beldanga which he is heading.

“I am a monk. I am not afraid of anything. But I am concerned about the outfit, especially the hospital attached to it and the residents of the Ashram. I have also informed the top officials of the state police about the threat call,” he said.

In the legal notice sent to the Chief Minister on Monday, Kartik Maharaj claimed that her comments were “baseless, false, and highly libelous”.

He also sought a reply from the Chief Minister within the next four days failing which he will initiate legal actions against Banerjee.

Meanwhile, the Vishva Hindu Parishad (VHP) has called for a protest against the comments made by the Chief Minister, not just against the Bharat Sevashram, but also the Ramakrishna Math & Ramakrishna Mission and ISKCON.

The protest rally titled ‘Sant Swabhiman Yatra’ will start from the residence of Maa Sarada at Bagbazar in North Kolkata and end in front of the ancestral residence of Swami Vivekananda at Simla Street, also in North Kolkata.

Opium seeds worth Rs 5 crore seized in Rajasthan

Jaipur, May 21 (IANS) The Anti-Gangster Task Force (AGTF) of Rajasthan Police has seized a large consignment of opium seeds weighing around 30 quintals smuggled in from Ranchi in Ajmer district.

The police have arrested the accused truck driver named Ramnarayan Bishnoi (55) from the spot. The seized drugs are valued at around Rs 5 crore.

With the latest seizure, the AGTF has seized opium extract worth about Rs 12 crore in the past week and arrested two smugglers, said Dinesh M.N., ADGP, Anti-Gangster Task Force.

On May 17, 22 quintals of illegal opium powder worth Rs 3.50 crore were seized in Bhilwara, which were being smuggled from Madhya Pradesh to Marwar under the guise of a cement container.

On May 19, over 21 quintals of opium extract, smuggled in a truck under the guise of rice carts, were seized in Sikar district. The consignment was valued at around Rs 3.50 crore.

Voting trend surely indicates repetition of 2019

The fifth phase of the 2024 general elections is over and now only the remaining two phases are to be concluded by the first of June 2024. By now, an overall voting percentage of 65% plus (likely to increase) has hit the votes-metre. This is for all practical purposes a very decent participation of voters at an all India level. Some parliamentary constituencies and states have recorded an extraordinary percentage of votes ranging from 70% to almost 90%. Jammu and Kashmir will also be exhibiliting a fine voting turnout after the 6th phase of the election process, which will most probably create a record of its own sorts. It may also go along with the national average of voters turnout ultimately, 

It has been generally observed that the voters in the states like Assam, West Bengal, Chattisgarh, Kerala, Tamil Nadu and Goa show an overwhelming interest in their participation in the elections while the voters in states like Bihar, Gujarat and Maharashtra show their participation in a moderate fashion. However, people in states like MP, UP, Rajasthan, Jharkhand, Orissa, Andhra Pradesh and Telangana will definitely show a far better turnout in their outings when the final phases of polling get concluded.

During the earlier phases of the current elections, a concocted narrative about the low turnout of voters was unleashed by certain vested interests in cohorts with some opposition leaders. They based their narrative on the initial figures of voters’ participation in the first two phases of polling. These elements even raised doubts about the ECI data released to the media. When the Election Commission of India released the updated data in regard to the voting percentage on its website, the ‘prophets of doom’ in the media and the opposition parties started crying foul. They even led the President of the Congress Party, Mallikarjun Kharge to seek clarification from the ECI in this regard.

Thereupon, the Election Commission of India issued a formal press release to clarify the matter. The release showed an increased percentage of votes polled consequent upon the updation of the data received from the basic sources connected with the conduct of elections. It also gave a detailed clarification of the procedure of the Commission in this context and also invited any sort of questions in this regard from the genuine voters and the political parties.

In addition, both the ECI officials and also the former CECs made it clear on the public platform that the ECI dedicated desk in this connection keeps on receiving the latest data from the polling centres (set up in the states/UTs) even after completion of the voting process on the voting day. It said that it generally takes three to four days to make a final assessment about the figures of the voter turnout. However, the ECI continues to update its website on a regular basis so that the latest information is made available to the public. In the current situation, the same process was undertaken by the ECI officials.

The fake narrative also attributed the so-called low turnout to the ‘voter-fatigue’ or to the ‘BJP-fatigue’ in the minds of the voters. Some even tried to interpret it as an indication of costing BJP and its allies their ground electorally. They went to the extent to call it an end for the BJP-NDA in the ensuing phases of the poll. But as the next phases showed a remarkable gradual increase in the voting, comparable to the 2019 and 2014 scenario, the fake narrative regarding the low turnout died its own death. One important factor that the 5th phase of voting brought out is that the overall phase-wise voting is almost identical to the earlier phase-wise voting of the last two general elections.

Here it needs to be mentioned that the officials of the ECI distributes complete information about the number of votes cast to all the polling agents present at the voting centres. Every press release update on behalf of the Election Commission of India carries the following footnote invariably: “Data displayed here are as per the information being filled in the systems by the field officer. This is an approximate trend, as data from some polling stations (PS) takes time and this trend does not include Postal Ballot. Final actual account of votes recorded for each PS is shared in Form 17C with all Polling agents at the close of polls”.

The voting pattern in India needs to be understood in an additional fashion as well. This is the story of fake or bogus voters in the voters-list. This factor is an integral part of the voting process throughout India. It was well explained by the action taken by the ECI, consequent upon the complaint filed by the BJP candidate, Madhavi Latha, in the Hyderabad parliamentary constituency. The ECI reviewed the voters list of the constituency and found 5.41 lakh bogus voters in it. Accordingly, in a swift action, the ECI deleted all these voters from the list. 

The deleted voters contained three types of fake voters i.e., voters who were already dead, voters who had since shifted from the constituency and were living at different places outside Hyderabad and those voters who were having their names in more than one Assembly segments of the parliamentary constituency. This situation is not an isolated one and almost every constituency in the country carries such bogus voters in its lists and has thus a huge impact on the arithmetic of the total voter turnout.

Keeping this dimension of the issue in mind, it is safe to say that the percentage of votes polled doesn’t reflect the actual or real percentage of votes polled. In all circumstances, the actual percentage of votes polled is always much higher than the data released by the ECI. There is invariably a need now for the ECI to review the voters-list in future at an all India level in view of the example of the Hyderabad PC. It is only then that the percentage of votes based on ECI data will nearly be reflective of the actual percentage. At this point of time, it remains far below the actual position.

Next, the ECI this time has included two more types of voters in the postal ballot scheme. In a measure welfare initiative, the ECI designated officials pay visits to the residences of the super-senior citizens of +85years of age and make them vote at their convenience. Secondly, they also visit those voters who are physically incapacitated to move; and help them cast their votes at their residences. This is a great gesture of the ECI for which they deserve all kudos. These two sections of voters comprise more than 2% of the total voters at a national level and have equally their impact on the total percentage of votes polled. The details of the postal ballots are generally known only on the day of counting and this ought to naturally further shoot up the percentages.

Taking all these factors into view, it is presumed that the total voting turnout will be almost equal to the last general elections and the data on the counting day would prove and establish this fact. Moreover, during the last more than three months of campaigning, there has been no upheaval of sorts, visible or invisible, politically or electorally speaking, that could impact the voting environment to the benefit of one side or the other. The strategy of the BJP-NDA adopted six months before the elections, in regard to the ‘400 paar narrative’ has done the trick. It has not even once allowed the opposition parties or their alliance to think about their own numbers. They have been whirlpooled by the narrative set by the PM Narendra Modi himself which originally was designed to motivate the NDA-BJP cadres. This was frankly admitted by PM Modi himself in a recent telecast interview to a prominent TV channel.

The leadership of the BJP-NDA was/is well aware of the fact that they had/ have reached their optimum in the states of North and West during the last general elections where they won a great chunk of seats and votes, both. Additionally, half of the constituencies they won there got them more than 50% of votes in their favour. In these circumstances, they needed only to consolidate their position this time and had nothing great to gain; but might have to lose a bit since they already reached the pinnacle. Therefore, they extensively focussed on the Eastern and Southern states of India ensuring to compensate loss of seats in the North and Western states. Most of the analysts and experts suggest favourable trends in favour of BJP-NDA in the states like West Bengal, Orissa, Andhra Pradesh, Telangana, Tamil Nadu and also Karnataka.

With 429 out of the 543 constituencies having already completed their voting process, the game is 80% over. At this point of time, 114 seats are to decide the fate of the contesting candidates on 25th May and Ist June followed by the counting on 4th June 2024. All said and done, the trends suggest a repetition of the 2019 scenario thus paving way for the BJP-NDA again to make a hat-trick of victory.

Most likely, the Indi-Alliance led by the Congress might blame the EVMs as usual with no scope of any introspection. The voting share of BJP-NDA will surely increase while the voting share of the Congress will surely decrease. How that would impact the number of seats is the only secret that 4th June 2024 would unfold. The deal for every side seems almost done, however, the Exit polls on 1st June 2024 in the evening will surely claim to be the ‘Exact-polls’…!
