Multiple child sex abuse cases involving madrassa clerics, PFI functionary and others: Kerala

Several cases of the POCSO (Protection Of Children from Sexual Offences) Act have been reported from different districts in Kerala over the past few days. A madrassa cleric who sexually assaulted a minor student was arrested in Kozhikode. The incident happened at Edakkad, following which Kannur native Shamseer was detained. The accused was produced in court and remanded.

The victim is from Muzhapilangad. Shamseer threatened to kill the minor if the victim disclosed the incident, but the minor informed about the sexual assault to his parents. The pedophile maulana was arrested based on the child’s complaint. Police suspect that he has also abused other students, and an investigation is ongoing.

Abdul Kareem, a teacher, was arrested from Vengara school in the Malappuram district for a POCSO offense the other day. He was detained based on the complaint of a 13-year-old student. The 7th-standard student informed other teachers about the harassment, and the school authorities approached the police.

More than 15 students studying in the sixth and seventh grades came forward with similar complaints against the pedophile teacher. During the investigation, the accused confessed to sexually abusing several underage female students during the class. The accused was the Malappuram North District President of the now-banned Popular Front of India (PFI).

On Friday, a POCSO case was filed against a teacher who tried to molest a student during the school festival. The incident took place during the Kollam district School Arts Festival. The accused, Yousuf, is a native of Kollam Kadakkal.

In the complaint, the student said the accused teacher misbehaved with her inside the school bus while they had gone for lunch. The other teachers were then informed, and later a police complaint was filed. The police said that they were searching for the absconding pedophile.

On Saturday, Ibrahim (50), a madrassa ustad, was arrested from Malappuram and charged with POCSO. He is a native of Pang in the same district and a teacher at Kodur Mundakkad Masjid. He was detained after a complaint received from Child Line was forwarded to the Malappuram Women’s Police station.

Vanitha Sub-Inspector Sandhya Devi is investigating the case, and Ibrahim was taken for a medical examination. Some members of the Mosque Mahal Committee alleged that he was arrested based on a ‘fake’ complaint and that this was a fabricated case. The police are conducting a detailed investigation into the incident.

In another incident from Kozhikode, a child marriage was reported from Kuttikattoor. Police said that the wedding took place on November 18. All the accused, including the girl’s parents and groom, are absconding. Police have intensified the search for the accused. News that a minor girl was married in a mosque near Kuttikattoor came out on Thursday.

The first accused is the groom, a native of Peringathur in the Kannur district. The minor girl’s parents are the second and third accused in the case. According to the police, those who performed the marriage will also be charged. The police will decide whether to press charges, including POCSO, after the girl undergoes a medical examination.

The girl, only 17 years old, was married off by her parent, a Muslim religious cleric. The child will turn 18 next April. The District Child Protection Department said that it is taking this incident very seriously. On Friday, the child protection officer gave a detailed report in the Kozhikode Chief Judicial Magistrate court.

Indian courts have given conflicting judgements on the issue of Muslim child marriage – at times, courts have sided with sharia which says that a Muslim girl is eligible for marriage as soon she hits puberty or turns 15, whichever comes first; at other times, the courts have ruled that POCSO law (which terms sex under the age of 18 as illegal) trumps Muslim sharia law.
