The gross violation of rights of the minor boy arrested in Baduria, WB over 2 weeks back for allegedly posting a photo on Facebook that was deemed objectionable to Muslims, has not gone unchallenged.

But it is not the high-flying social activists & Lutyens’ NGOs which have come to the aid of this poor boy, son of a daily-wage labourer who lost his mother 7 years back. It is a simple, grass-roots human rights organization called Hindu Samhati (HS), founded in 2008 by ex-RSS pracharak Tapan Ghosh.

We spoke to Hindu Samhati’s Vice-President, Shri Devdutta Maji, on this matter and he informed us that once HS learnt of the boy’s arrest they immediately swung into action. As the house where the boy was living with his uncle was completely burnt down on the night of Sunday,  2 July – the same night the boy was arrested by WB police – by a Muslim mob, finding documentary evidence of his age was not easy.

But on 12 July they finally managed to unearth his birth certificate which clearly shows the boy was born on 6 July 2000 (6.7.2000) – which actually means he was just 16-years-old when he was first taken into custody by WB police.

Hindu Samhati has provided us a copy of the birth certificate which we are reproducing below after hiding the parts which reveal the minor’s identity –

At the request of the boy’s uncle, the very same day Hindu Samhati filed complaints with WB CM Mamta Banerjee and  WestBengal Commission for Protection of Child Rights. Devdutta Maji shared copies of both complaint letters with HinduPost –

Devdutta Maji further informed us that apparently the boy’s date of birth was not mentioned in the FIR filed by WB police – so there appears to be a plan afoot to try him as an adult in the matter, in gross violation of the  Juvenile Justice (Care and Protection of Children) Act.

The police has to produce the minor in court on 20th July, and Hindu Samhati lawyers will be present to argue for juvenile law to be applied in this case. HS is prepared to knock doors of High Court if the lower courts rejects their argument.
