Kerala High Court has stayed a motion that was to be presented in the Kozhikode Corporation Council meeting today demanding that the Central Government withdraw from implementing the Uniform Civil Code (UCC). The court directed to withdraw the move and pointed out that such resolutions are against the municipal rules.
The absurd ‘resolution’ was introduced by the Communist Party of India Marxist (CPM) members in the council meeting of Kozhikode Corporation. BJP councilors resisted the move and lady councilor Navya Haridas issued a notice to the mayor and the secretary asking them not to permit the motion. They reminded the communists that the resolution was outside the corporation’s ambit and violated the Kerala Municipality rules.
CPM that rules the corporation refused to deny permission to present the resolution. This was when BJP approached the High Court. The court blocked agenda item 137 in the council meeting scheduled at 3 pm today. The petitioner requested to stop the presentation of the resolution under sub-rule four of the Kerala Municipality Meeting Rule 18. The court upheld the argument that only the administrative matters of the local self-governing bodies can be presented as resolutions in the council meetings.
The lady BJP councilor pointed out that the Corporation Council has no competence under the Constitution to pass resolutions against the laws of the Central Government. Bringing counter-resolutions on constitutional matters is a violation of the law, she added.

The Kerala High Court had also blocked the CPM’s move to push a resolution against the NITI Aayog in the Corporation Council meeting in 2022.
