Bareilly court orders jail term for girl who filed false rape case, justice for youth who spent 1653 days in jail: UP

The Bareilly Sessions Court passed a landmark judgment ordering a jail sentence for a girl who had filed a false rape case. The court highlighted that the judgment is aimed at preventing the misuse of the law due to which actual rape victims suffer.

In 2019, the girl’s mother had accused the youth of raping her daughter. As a result of the accusation, the youth had to spend 1653 days (4 years, 6 months, and 8 days) in jail. The girl has to spend the same amount of time in jail, along with paying a fine of 5,88,822 rupees.

Justice Gyanendra Tripathi made strict comments when the case was proven to be false. “Women cannot be allowed to take undue advantage of the law to target men. The girl’s attempt to trap the youth by falsely accusing him of rape amounts to misuse of laws meant for women’s welfare. The girl used the police and court to achieve her illegal objectives. Therefore, it is only fair that she gets equally punished, along with paying a fine,” the court observed.

According to reports, a case of rape was filed against the youth in 2019. The girl’s mother had alleged that the youth had mixed intoxicants in the prasad and fed it to her daughter. She further alleged that he later took her to the hotel and raped her. Based on the complaint, the youth was arrested and remained in jail till 8 April 2024. However, the reality came to light when the girl testified in court that she wasn’t raped and admitted that she had filed a false case.

Justice was served in this case with the youth being freed and the girl being punished for filing a false case. We have often seen men suffer due to such false cases, especially in cases where the SC-ST Act is applied. The Bareilly Court has set the right precedent by making women accountable.
