“Same-Sex Marriage hearing, Day-6: ‘What if someone in future challenges restrictions on incest?’, asks SG Tushar Mehta; ‘Far fetched’, says CJI”, Swarajyamag, April 28, 2023:
“A Constitution bench of the Supreme Court continued to hear the batch of petitions arguing for legal recognition to same-sex marriages in India. Today is the sixth day of the hearing.
Appearing on behalf of the Union government, that is opposing the SC granting legal validity to same-sex marriages was Solicitor General Tushar Mehta.
During the course of his submissions, the SG pleaded:
“Kindly visualize this- from the very beginning I am attracted to those persons who are mentioned in the degree of prohibited relationships. Incest is not uncommon but it is prohibited worldwide. But I’m attracted to my sister. We are consenting adults entering into activities within privacy. And we claim our right of autonomy, right of choice…based on that, can someone not challenge that why this restriction?…..”
