Justice Chandrachud needs to reconsider the definition of a free society and free speech

Justice Chandrachud of the Supreme Court of Bharat made a curious remark while hearing the case about Sudarshan TV in the case of its programme on what he called “UPSC Jihad”. According to reports, Chandrachud remarked  “This is so insidious! Can this be tolerated in a free society?” Leaving alone the fact that the honourable justice seems biased from the start here against Sudarshan TV, let us see how the “free society” functions in Bharat.

Just yesterday, “eminent” cricket enthusiast and part time historian Ramchandra Guha made a tweet about a government committee established to study culture of Bharat from 12000 years ago. Many Christians, who might believe that the world was created in 4004 BCE might object to that, but Guha, probably not a Christian, had a different point of criticism.

Guha, as a representative of Bharatiya “free society” liberals, insinuated that almost all the persons in this committee are Brahmins. This Brahmin counting by Guha is nothing new. The dastardly Pulwama attack also brought forth such caste counting spree with Caravan magazine claiming that only 8 out of 40 out of hutatma soldiers were from higher caste, and alleging the higher castes were sending lower caste troops to death. Never mind that the PM is not a higher caste and that 20% of troops are in consonance with their population in Bharat’s population.

One could have pointed out that only 1 in 40 or just 2.5% of Muslims were among those hutatma soldiers. This is much below their share in population. However, one is reasonably sure that it would have probably violated the norms of “free society” as seen by Justice Chandrachud! Predictably, the article of Caravan was used by caste fanatics and drew no condemnation from most of our liberal friends.

Qualitatively, there is no difference between Sudarshan counting Muslims in UPSC exam and Caravan counting Upper castes among soldiers. However, one must remember that the allegation of Caravan is a castle built on thin air, while there is actually some truth in the investigation of Sudarshan TV. HinduPost did a detailed piece on this issue and the findings actually give credence to charges of Sudarshan TV.

The issue of free speech must be debated and hate speech must be curbed. There are no two ways about it. However, the hypocrisy that normalises baseless allegations against one community and sees red on even the justified criticism of other community must stop. Given a chance, such liberals could criticize Nobel Selection committee as to why 8 out of 10 Nobels to people born in Bharat were awarded to Brahmins. However, they will never have the courage to ask that why a vast majority of terrorist attacks in Bharat are carried out by Muslim extremists.

Justice Chandrachud would do Bharat a service by appropriately seeing the whole issue, use his powers to widen the scope of the case and come out with a well reasoned judgment on the issue.
