Delhi HC rejected the bail application of Mohammed Ibrahim on 27 September in a case relating to anti-Hindu Delhi riots where he has been accused of causing injuries to police personnel and being involved in the murder of Head Constable Ratan Lal. The order was passed by the single judge bench of Subramonium Prasad.
Delhi HC says riots were pre-planned
Reporting on the court observations, legal website Lawbeat notes:
The Delhi HC observed that the riots which shook the national capital of the country in February 2020 “evidently did not take place in a spur of the moment, and the conduct of the protestors visibly portrays that it was a calculated attempt to dislocate the functioning of the Government as well as to disrupt the normal life of the people in the city”.
It further observed that the systematic disconnection and destruction of the CCTV cameras also confirms the existence of “a preplanned and pre-meditated conspiracy to disturb law and order in the city”. The bench said this was evident from the fact that innumerable rioters ruthlessly descended with sticks, dandas, bats etc. upon a “hopelessly outnumbered cohort of police officials.”
The court was of the opinion that even though the petitioner was not seen at the scene of crime, he clearly was a part of the mob for the sole reason that “the Petitioner had consciously travelled 1.6 kms away from his neighbourhood with a sword which could only be used to incite violence and inflict damage.”
The court also rejected Ibrahim’s stand that he was brandishing a sword in person defence and for the safety of his family. The court observed that this was doubtful as he was atleast 1.6 km away from his place of residence and was in no imminent danger.
The court said that in a democratic society “individual liberty cannot be misused in a manner that threatens the very fabric of civilised society by attempting to destabilise it and cause hurt to other persons.”
11 accused had applied for bail with the Delhi HC in connection with this case of which 8 have been granted bail while bail applications of three others including Ibrahim have been rejected.
on 14 September, Delhi HC had accepted the bail applications of Shahnawaz and Mohd Ayyub and rejected the bail pleas of two other accused, Sadiq and Irshad Ali. Earlier on 3 September, Justice Prasad had given bail to Furkan, Arif, Shadab Ahmad, Suvaleen, and Tabassum as well.
While Ibrahim’s bail plea was rejected, the Delhi HC granted bail to another accused Mohammad Salim Khan.
Constable Ratan Lal lost his life from grave injuries inflicted by stone-pelting mobs during anti-CAA protests in Delhi’s Maujpur/Gokalpuri area. Several police personnel were injured in that incident as well. The autopsy revealed that Ratan Lal had been injured with a bullet wound as well.
Originally from village Sadinsar in the Sikar district of Rajasthan, he left behind a wife, Poonam & 3 young children – two daughters, Siddhi (12) and Kanak (10), and a son Ram (7). His wife had lamented as to why unarmed police were sent to face the violent mob of anti-CAA ‘protestors’.
In early September, Delhi sessions gave bail to Tahir Hussain’s brother and two other accused in the anti-Hindu Delhi pogrom where several people including Intelligence Bureau personnel Ankit Sharma were murdered in cold blood by Islamists in the name of anti-CAA protests.
Anti-Hindu Delhi riots have exposed the Bharatiya liberals who are hopelessly colonized along with being morally corrupt and extremely anti-Hindu. Similarly, even though the Delhi HC has highlighted that the riots were pre-planned, judicial pronouncements in the case have raised questions regarding the neutrality and non-partisan nature of Bharat’s judiciary as well.
