Violation of child rights to target Chidambaram Dikshitars? Shocking details revealed in NCPCR probe

After denying Tamil Nadu Governor’s charge about the DMK government forcing Chidambaram Dikshitar girl children to undergo the banned two-finger test through the DGP, DMK has unleashed media to misinterpret NCPCR member’s statement regarding the same. Media reported that the NCPCR member confirmed that the two-finger test was not performed. But he clarified on Twitter that the media published an “untrue statement” and that the Governor’s charges about the test were true.

Why Two Finger Test?

The anti-Hindu DMK government in TN has been ruthlessly going after the Chidambaram Dikshitar community after the HRCE was royally shown the door in its attempt to take over the Chidambaram Nataraja temple. As HRCE couldn’t find any mismanagement in financial or administrative matters, the DMK government started targeting the community with the help of NGOs by filing child marriage cases against them.

Using this as a pretext, Dikshitar men were booked and arrested under POCSO and their girl children were forced to undergo banned medical examinations like the two-finger test to humiliate and make them submit. As police and local authorities were hand in gloves with those who were out to destroy the Dikshitar tradition, the community sought Governor RN Ravi’s help. Recently revealed shocking details about how minor girls were subjected to the banned two-finger test, driving them to the point of suicide.

What NCPCR Team Found

After the media picked up his statement and it gained attention, the DMK government denied the charges through DGP Sylendra Babu. However, the National Commission for Protection of Child Rights(NCPCR) sought an explanation from the Chief Secretary of TN and appointed a team to investigate the issue. Dr Anand who headed the team investigated Dikshitars involved in the issue, their families and the concerned girls.

Dr Anand gave bytes to the media about the investigation and said that “even though the two-finger test was not done, the children were harassed by touching their private parts” which the media twisted to suit its own narrative. It reported that “the two-finger test was not performed on the minor girls, so the Governor’s statement is a lie” giving way to abusive comments against him calling him a liar. Dr Anand had to issue a clarification on Twitter saying that his statement was misconstrued. He later said in a press conference that “it is recorded in documents that the hymen is intact which means they underwent the two-finger test”.

Instead of investigating the issue thoroughly, the media is hell-bent on proving the Governor and the NCPCR wrong. The News Minute, English Murasoli(DMK mouthpiece) as it is fondly called, for example, went to doctors to give credibility to the heinous act. After confirming that the medical report indeed says, “hymen is intact” it quoted one Dr Shanthi AR, secretary of the Doctors Association for Social Equality.

She said “After the two-finger test was banned, we visually examine the hymen through external genitalia. This is the procedure stipulated after the ban, and it is being followed by the doctors at both the national and state level” and attributed political motives to Dr Anand’s statement. He on the other hand has assured that the commission has ample evidence from doctors, police and the children to prove that the test was indeed performed.

Was the Test a Violation of Child Rights?

TNM should have perused its own article on the ‘two-finger test’ from May 2022 before writing the above article. The article was written after the Madras High Court pulled up the medical fraternity for continuing with the banned test even after a Supreme Court ruling against it. It says, “the test is unscientific because the hymen can rupture due to several reasons other than sexual intercourse, including playing sports, riding a bicycle, using tampons, or during medical examinations..

It is also a myth that the hymen is simply an untouched membrane that covers the vagina if the woman is a virgin. Clinicians observe that the hymen ruptures in the first few days after birth and may either remain as a rim around the vaginal opening or as a membrane with one or more small ruptures that partially cover the vagina”.

The article also talks about the rights of ‘sexual assault victims’ which is what the Dikshitar children would have been termed as under the POCSO Act. It says, “According to the MoHFW guidelines, the doctors should inform the survivors or their guardians (in case of minors) about what will be done. If the survivor is a child, the parent or guardian has the full right to refuse either only the medico-legal examination or evidence collection or both”.

The Dikshitar children have told Dr Anand that they were forced to undergo medical examination and that police forced them to confess that they were married. Did they negative in reply when asked about sexual abuse and the test performed without their consent?

Chandrashekar, the lawyer representing the Dikshitars told TNIE, “Cuddalore district police special force coerced the girls into giving statements that the test was not conducted”. He also pointed out that under the Child Marriage Act, the maximum punishment is two years of imprisonment and questioned why Dikshitars were arrested when the SC has said that arrest is not necessary for cases in which the sentence is under 7 years.

Humiliating Dikshitars by Getting Personal

Now Dravidianists have stooped further by sharing pictures of minor Brahmin children claiming them to be the Dikshitar children married and “sent for first night”. Who in their right mind would take pictures of girls at such an occasion and those who are going against the law at that? After the details of minor children being sexually harassed in the name of medical examination to satiate the hunger of anti-Brahmin anti-Hindu Dravidianists emerged, they have started doing what they are best at; Shaming those who stand up to their bullying through doxxing.

The fact is that Chidambaram Dikshitars are targeted because the DMK government’s ‘efforts’ to take over the temple were thwarted. As they couldn’t be bent to serve DMK’s will, the usual tactics of shaming their enemies by accusing them of horrible things and making them undergo humiliating trials to force them into submission. They were arrested, their womenfolk made to sit in police stations at ungodly hours, their children were harassed and forced to confess by a pliant police department and humiliated by unethical medical tests being performed on them.

NCPCR member Dr Anand informed the media that “In page number 115 of the case sheet prepared by the police, they have clearly stated that the hymens of both the minor girls were intact”. The News Minute confirmed it by talking to an official involved in the case. The official said, “There is a column in the formal medical examination sheet which asks if the hymen is intact or not and the doctors have to fill it out”. 

Questions to DMK Government and Media

  1. Did the girls answer in negative when asked about the “first night” and the test was performed without their consent?
  2. The test was done to ascertain the possibility of sexual assault under the POCSO Act. Why are Dikshitars still being held under the Act when the test result is negative?
  3. Why do Dravidianists still insist that the children were sexually abused and that Brahmins are defending the abuse of their own children?
  4. Why hasn’t the media asked this most pertinent question(2), and insists on following Dravidianist propaganda of humiliating Dikshitars and discrediting the Governor?
