HC denies bail to man who raped minor Hindu girl and pressurized her family to convert to Islam

A single bench of Allahabad High Court comprising Justice Ajit Singh on Thursday rejected the bail application of one Abdul Rahman, accused of raping a minor Hindu girl and then pressurizing her and her family to convert to Islam.

Rahman (22) had entered the house of the 14-year-old girl on 11 January and raped her. During the crime, he made a video clip and then tried to blackmail the girl by threatening to leak it.

On January 13, the girl narrated the incident to her parents but as the accused were influential in the area, the family could not muster courage to lodge a complaint. When the father of the girl asked Rahman’s father to get the video clip deleted, he said that when the complainant’s entire family will convert to Islam then Rahman will marry his daughter else he himself (the father) will marry her.

Finally, the father of the victim lodged a case on 26 January, and Rahman and his father were arrested from near a railway station while they were trying to escape.

Rahman was booked under sections 452/376/120-B IPC, and section 3/4, 17/18 POCSO Act, and section 3/5(1) U.P. Prohibition of Unlawful Conversion of Religion Act 2020 and section 66E Information Technology (Amendment) Act.

Opposing the bail application of the accused, the  Additional Government Advocate (AGA) said that the video clip which was made of the minor victim had been taken in possession by the police during the investigation. He added that the girl was a minor aged about 14 years and the accused and his family also tried to pressurize the victim’s family to get their religion converted.

Rejecting the bail, the Single Bench held,

“After considering the facts and circumstances of the case and considering the seriousness of the matter and minor daughter was raped and the entire family was asked to convert their religion, without expressing any opinion on the merits of this case, this court does not deems it fit to release the applicant on bail.”

It is not clear from reports whether Rahman’s father, who made the sickening proposal to the girl’s father that either he or his son would marry the minor rape victim if the entire family converted to Islam, is still in jail or has been granted bail.
